  • Hygiene items, sanitary products;

In what cases is a product subject to return or exchange?

  • The product does not satisfy the color, size, style;
  • The item does not match the dimensions or configuration.

List of technically complex goods of poor quality subject to return and exchange

Technically complex goods include products that can perform several functions and involve several complex technological processes during production. The list is as follows:


  • Navigation equipment, telephones;
  • Computer equipment, MFPs, game consoles;
  • Televisions, satellite television;
  • Photo and video equipment, accessories;
  • Home appliances (refrigerators, freezers, washing machines, water heaters, climate control equipment, ovens, stoves);
  • Machines for agricultural activities;
  • Snowmobiles.

It is permitted by law to return a technically complex product of inadequate quality or exchange a similarly technically complex product or receive a refund within 15 days after purchase. After this period, you can return products if you have one of the following indicators:

  • There is a significant lack of quality (there is no prospect of repair, a significant financial contribution for repair is required, use is dangerous to life);
  • Inability to use the product for 30 days of any year of the warranty period.

If the item is being repaired and the repair warranty period (45 days) has expired, it can also be returned.

Within what period can I return a product of poor quality?

Any product can be returned to the place of purchase within 14 days from the date of purchase if it differs in size, dimensions, color, or configuration. Also, the item must not be on the list of non-food products prohibited for exchange.

Products of inadequate quality must be returned to the store within the warranty period or expiration date. If there is no such period, then 2 years are given for return. But in the case of technically complex products, they can be returned within 15 days from the date of purchase. The period for returning funds is 10 days from the date of filing the claim.

If we are talking about, then, according to the law, this is done within 14 days.

Currently in Russia, the consumer in relations with the manufacturer and seller is endowed with a wide range of rights. The Law of the Russian Federation “On the Protection of Consumer Rights” (ZOPPP) No. 2300-1, adopted back in 1992, establishes for the latter serious obligations to ensure the quality of products and the awareness of ordinary citizens regarding their properties. And these rules are imperative, that is, local authorities, including in Moscow and St. Petersburg, do not have the right to change them.

However, many provisions of the law require additional consideration; they are clarified by by-laws, which must be considered in their entirety. Consumer rights to replace an item without visible defects

According to Art. 25 of the PLA, the buyer, within 14 days from the date of purchase of the item (not counting the day of purchase), has the right to exchange it for a similar product of a different size, style, shape, color, as well as configuration or dimensions. This is allowed only if the item has not been used, all seals and labels have been preserved, and the consumer has a cash or sales receipt (or other document confirming the fact of purchasing the goods from a specific seller). Witness testimony can also be used as evidence, subject to the consent of both parties.

If a similar product suitable for the buyer is not on sale on the day of application, the citizen has the right to demand termination of the contract with all the ensuing consequences: the return of the item to the store and the money paid for it to the buyer.
However, there is a list of goods that cannot be returned or exchanged within 14 days on the grounds that the product does not fit the style, shape, color, dimensions or configuration. That is, we are talking about goods of proper quality. They cannot be returned within 14 days, which is due either to their specific properties or other logical considerations of the legislator. This list was approved, as mentioned above, by Decree of the Government of the Russian Federation No. 55 of January 19, 1998

What products cannot be returned?

List of goods that are not subject to return and exchange in 2018-2019 according to the law of the Russian Federation:

  1. goods intended for use for preventive purposes, purchased in pharmacies, but used at home (for example, sanitary and hygiene items made from various materials, medical devices and apparatus, lenses, children's cosmetics, items for the care of newborns and young children) ;
  2. products intended for personal hygiene;
  3. Perfumes and cosmetics;
  4. fabrics and accessories, cable products, construction and finishing materials, the sale of which is carried out on a per-meter basis; sewing and knitted underwear and hosiery;
  5. products and materials intended for storing or interacting with products, made entirely or partially from polymers (dishes, special containers, packaging, including disposable ones);
  6. household chemicals;
  7. furniture intended for use in everyday life, both individual items and sets, sets;
  8. pesticides, agrochemicals;
  9. jewelry, products made of precious metals and precious stones, including faceted precious stones or inserts;
  10. cars, as well as pleasure craft and watercraft intended for domestic use only, trailers, mobile agricultural machinery;
  11. complex technical products with warranty periods;
  12. civilian weapons;
  13. The legislator also classifies animals as non-food goods that cannot be exchanged; it is quite logical that plants cannot be replaced with a similar product of a different color;
  14. books, maps, other non-periodical publications.

Resolution 55 in paragraph 11 of the above list provides a list of technically complex goods, which includes machine tools, electrical appliances, photographic and film equipment, radio-electronic equipment, gas equipment, computing, duplicating and fax equipment, telephones, electric musical instruments and electronic toys, even wristwatches with several functions . At the same time, by Decree of the Government of the Russian Federation No. 924 of November 10, 2011. a separate, more detailed list of technically complex goods was introduced.

Consumer rights in relation to goods from the List

Any goods included in the list of goods of good quality that are not subject to return and exchange according to the law of the Russian Federation in 2018-2019 can in fact be returned, but on the condition that deficiencies are found in them. Return rules and terms are regulated by Art. 18 PDO.
However, it is worth remembering that they cannot be cited as shortcomings on the basis of Art. 25

  • style;
  • size;
  • equipment;
  • dimensions;

Changes to the list and final provisions

The list of goods of good quality that cannot be exchanged or returned has not changed in 2019; in general, the amendments to this document were quite few. Major changes were made at the end of 1998; in 2015, jewelry was added to the list; in 2016, the list of technically complex goods and goods intended for storing and using food products was edited (clause 6).

When determining which goods cannot be returned within 14 days and when forming the corresponding list, the legislator used the term “non-food”, thus these restrictions do not apply to food products.

In practice, difficulties arise when classifying goods into one type or another, especially for technically complex goods. Situations in which it is necessary to return the goods to the seller do not necessarily have to be related to the presence of defects in the purchase.

According to Russian law, you can issue an exchange or return for a product that does not suit the buyer according to any criteria. For example, by shape or style, color.

The main thing is to return the goods within 14 days. The buyer must keep receipts for the goods (merchandise or cash register). However, if they are not available, the buyer may rely on witness testimony. If we are talking about clothing, it should not be worn or show signs of use. Also, the buyer must preserve the presentation (tags, packaging) and consumer properties of the goods.

Moreover, if the seller does not have a similar product of a different size, it can be returned (in other cases, only an exchange of goods is allowed). List of goods that cannot be exchanged

However, the rules discussed do not apply to every purchase. The Government Decree (the latter dates back to 2012) defines a list of goods that cannot be returned. The purpose of determining the list of these goods was to protect the interests of the seller and ensure the safety of future buyers.

Based on the exchange and return rules, you cannot return used goods, goods without seals and labels, or those purchased more than two weeks ago.

The list of non-returnable items includes 14 groups of goods.

1. Medicines and medical products. This is, for example, medical equipment and devices.

2. Personal hygiene products. Thus, it will not be possible to return a wig, curlers, toothbrush or comb. Therefore, you should carefully approach their choice.

5. Knitted items (, hosiery, etc.) cannot be returned.

Shopping isn't always fun. Sometimes you come across products that are not suitable for use or do not fit certain parameters. The buyer has the right to return and exchange. Regulations governing returnable goods

The entire range of products available for free sale can be divided into three groups: food, non-food and technically complex goods.

The list of goods that cannot be returned or exchanged is determined by Regulation No. 55 of 1998. It is worth considering separately the case if the purchased product has obvious defects (inoperative, expired food products). Let's consider products that do not have obvious deviations.

Non-food items that cannot be returned

  • Socks, tights, stockings and other wardrobe items from this category.

  • Household products of chemical origin.
  • Fertilizers and agronomic chemicals.
  • Weapons and their equipment permitted for use.
  • Motor vehicles.
  • Small-sized sea and river transport.
  • Complex technical products used for domestic purposes: electrical appliances, kitchen appliances and computers.
  • Finished products from linen knitwear and related to linen textiles.
  • Printed publications published in a non-periodic manner: books, booklets and calendars.
  • Containers for storing and transporting food products, including disposable containers and cling film.

What food products cannot be exchanged?

If you can get money back for a non-food product you don’t like, this option is not possible with food products. The only way to protect yourself is to pay attention to the quality of the product when purchasing. The product must meet the following requirements:

  • appearance, consistency and structure are in adequate condition: fresh aroma, decent appearance and no abnormal sensations to the touch;
  • the presence on the packaging of codes and stamps indicating that the product complies with current standards. Special authorities ensure compliance with their requirements.
  • sufficient shelf life.

If one of these signs is missing or does not inspire confidence, there is a chance to return the product to the store and collect the money. The presence of obvious signs of unsuitability in the product - mold or foreign odors or inclusions - is a reason to contact the sanitary and epidemiological authorities and Rospotrebnadzor.

List of technical products that cannot be returned

This regulation is approved at the legislative level. Official document – ​​Decree No. 924 of 2011. According to it, here is a list of goods that cannot be exchanged or returned:

  • civil aviation devices with an electric motor;
  • cars;
  • motorcycles and other vehicles used in agricultural work;
  • boats and yachts;
  • TVs;
  • computer equipment: stationary and portable computer equipment, including laptops and tablets;
  • digital equipment;
  • all types of household appliances;
  • kitchen appliances: microwaves, ovens, coffee machines, dishwashers and washing machines;
  • sports equipment and vehicles;
  • laser MFPs;
  • navigation technology with a touch control system, including mobile phones and smartphones;
  • car and hand-held navigators.

All products not listed in this list can be returned to the seller or replaced with analogues. It is worth special mentioning the medical assortment that is not subject to resale:

  • products intended for preventive purposes;
  • medications used without a doctor's prescription;
  • medications required for home and car first aid kits;
  • medical preparations;
  • supplies and means used to care for children;
  • instruments, devices and other accessories for medical procedures;
  • means for maintaining body hygiene.

If medical products have clear signs of poor quality, are unfit for use, or are sold past their expiration date, you can return them and receive a quality copy in return.

The reasons for refusing to accept a return are simple. For example, for some drugs and products it is impossible to determine whether they have been used or not. This could be underwear or items to maintain body hygiene. The second reason is damage to the packaging and boxes, after which it is problematic to resell the product.
