In accordance with Article 14 of the Federal Law "On the contract system in the field of procurement of goods, works, services to meet state and municipal needs" the Government of the Russian Federation

decides:

1. Approve the attached list of certain types of food products originating from foreign countries, in respect of which access restrictions are established for the purposes of procurement to meet state and municipal needs (hereinafter referred to as the list).

2. Establish that for the purposes of procurement of certain types of food products included in the list, the customer rejects from participation in competitive methods of identifying suppliers all applications (final proposals) for participation in determining a supplier (hereinafter referred to as the application), containing proposals for the supply of food products originating from foreign countries (except for member states of the Eurasian Economic Union), provided that at least 2 satisfying procurement notices and (or) procurement documentation applications are submitted for participation in the determination of the supplier, which simultaneously:

contain proposals for the supply of types of food products that are the object of purchase and included in the list, the country of origin of which is the member states of the Eurasian Economic Union;

do not contain offers to supply the same type of food product from the same manufacturer.

3. Confirmation of the country of origin of goods (food products) included in the list is the indication (declaration) of the name of the country in the application in accordance with the Federal Law "On the contract system in the field of procurement of goods, works, services to meet state and municipal needs" origin and manufacturer of food products included in the list. The name of the country of origin of goods (food products) is indicated in accordance with the All-Russian Classifier of Countries of the World.

4. When executing a contract, during the conclusion of which applications were rejected in accordance with the restrictions established by paragraph 2 of this resolution, it is not allowed to replace the food product with:

a food product whose country of origin is not a member state of the Eurasian Economic Union;

a food product from another manufacturer, the supply offer of which was contained in applications that were not rejected in accordance with the restrictions established by paragraph 2 of this resolution when concluding this contract.

5. The restrictions on the admission of food products included in the list established by this resolution do not apply in the following cases:

placement of notices about the procurement of food products included in the list in the unified information system in the field of procurement and (or) sending invitations to participate in the determination of a supplier in a closed way were carried out before the entry into force of this resolution;

purchases of food products included in the list were carried out by customers specified in Part 1 of Article 75 of the Federal Law "On the contract system in the field of procurement of goods, works, services to meet state and municipal needs" on the territory of a foreign state to ensure their activities in this territory .
