Expert opinion on products- a form of a document certifying the safety for humans and the quality of the product in terms of microbiological, physico-chemical, toxicological, organoleptic, radiological and other indicators (depending on the type of product).

An expert opinion is issued only after laboratory testing of products for compliance with the unified sanitary-epidemiological and hygienic requirements for goods subject to sanitary-epidemiological supervision (control) on the territory of the EurAsEC. There is no single sample form for an expert opinion, therefore, each country sets its own requirements for these forms, and each territorial sanitary and epidemiological supervision authority can develop its own form.

The list of goods for which an expert opinion can be obtained, with a view to their successful and quick sale to consumers, is specified in Appendix No. 1 to the decision of the Commission of the Customs Union No. 299 dated May 28, 2010 (Section I List of goods subject to sanitary and epidemiological supervision (control) ).

It should be noted that before the adoption of the new rules of the Customs Union in the Russian Federation, there was such a document as a FEZ (sanitary and epidemiological conclusion), which was issued for most types of products sold in the country. However, since 2010, this document has been abolished, and expert opinions have been issued instead.

Why should you get an expert opinion?

Despite the fact that according to the legislative acts of the Customs Union an expert opinion is not mandatory, in the business environment such a document is considered very significant. As part of the sanitary and epidemiological study of technical documentation, the examination is carried out:

  • for enterprises and their groups depending on the hazard class (1-5). Projects to substantiate the size of the SPZ (sanitary protection zones), including those with an assessment of the risk to public health, are subject to verification;
  • in relation to projects containing MPE standards for polluting the atmosphere;
  • regarding materials for determining the final size of the SPZ for enterprises from hazard class 1 to 5, including those with a health risk assessment.

Sanitary and epidemiological examination of products is carried out on the basis of the manufacturer's application. Based on the results of the check for compliance of products with established quality standards, the manufacturer can issue a certificate of state registration of the product. The following product groups are subject to mandatory verification:

  • food, including dietary supplements for food, specialized products and intended for baby food;
  • non-food, including perfumes and cosmetics, as well as products subject to mandatory state registration in accordance with the law.

The cost of conducting such an examination in private varies from 5,430 to 47,775 rubles, including VAT, depending on the type and complexity of the product.

Commercial organizations can apply to the center for sanitary and epidemiological examinations aimed at checking:

  • draft technical documentation related to food products (TU, TI, etc.) for compliance with quality standards and regulations;
  • technical documentation related to the establishment of expiration dates for a specific product.

The center's experts evaluate the results of laboratory studies and tests, including the rationale for the use of expiration dates. The average cost of conducting commercial expertise is 8,000 rubles including VAT.

The equipment and the staff of the center make it possible to carry out hygienic and other types of assessments, including those aimed at analyzing the impact of the environment on public health, as well as assessing potential risks to the health of citizens.

It should be noted that services to citizens and organizations are provided within the framework of the One Window program. This is convenient, since all applications and technical documentation are sent to a single contact information, regardless of the type of expertise required. Subsequently, the received documents are sent to specialists in a particular field (Photo 5).

How and when products are checked for quality by Rospotrebnadzor

In order to fulfill the functions assigned to Rospotrebnadzor to control the sanitary and epidemiological situation in the country and protect consumer rights, inspections are carried out on an ongoing basis at enterprises and commercial organizations.

Inspection is carried out on a scheduled and unscheduled basis. An unscheduled examination to check products for quality by Rospotrebnadzor can be appointed in cases stipulated by law:

  • at the request of the chief state sanitary doctor, his deputies;
  • by definition issued in accordance with the Code of Administrative Offenses of the Russian Federation within the framework of an administrative offense;

Conducting an examination for state needs, in particular, when supervising the sanitary and epidemiological state, licensing activities, as well as monitoring the social and hygienic situation in the country, is carried out free of charge. Examinations on personal applications of citizens and organizations are carried out on a contractual basis, the rate for each type of examination is fixed and posted in open sources, including on the website of Rospotrebnadzor and its representative offices in the regions.

Based on the results of the inspection, a conclusion is prepared on the conformity or non-compliance of the product with quality standards and an appropriate certificate is issued. Information about the results of the examination is entered into the Register of Sanitary and Epidemiological Conclusions of Rospotrebnadzor, located on the organization's website at rospotrebnadzor.ru/deyatelnost/informatics.

Types of disinfectants permitted by Rospotrebnadzor

What is needed to obtain an expert opinion from Rospotrebnadzor

Coordination of the SPZ project in the FBUZ “Center for Hygiene and Epidemiology”


FBUZ “Center for Hygiene and Epidemiology” is a state institution reporting to Rospotrebnadzor. It is within his competence to carry out sanitary and epidemiological expertise your company's project.

Based on the results of the examination, the customer is issued expert opinion on the compliance (or non-compliance) of the submitted documentation with a number of hygienic standards, in particular, the required quality of ambient air and indoor air. After receiving the expert opinion, it is transferred to Rospotrebnadzor for further approval of the project.

To obtain a sanitary and epidemiological expertise, a company must generate and submit the following package of documents:

  • an application for an examination, filled out according to the model and including information about the details of your company (legal address, current account, bank, TIN, KPP), about the purposes of the examination, about the list of attached documents;
  • initial permit documentation (urban planning and cadastral plans of the land plot, lease agreement (or certificate of ownership));
  • situational plan (on a scale of 1 to 2000), master plan (on a scale of 1 to 500) with the obligatory presentation for both cases of the boundaries of the land plot of present and future nearby buildings;
  • a volume of the draft justification of the size of the sanitary protection zone, containing: key information about the facility, the rationale for the location of the sanitary zone as a protection against hazardous effects extended to the external environment, cartographic data, a list of environmental measures, a plan of field studies necessary to confirm the sufficiency of the calculated SPZ.
Price
Legislatively (Order of Rospotrebnadzor dated July 19, 2007 N 224 (as amended on July 22, 2016), the following price list is determined.

The complexity group is a determining factor in the cost of the service and is established by specialists of the Ministry of Health of the Russian Federation by expert means. Approval of the sanitary zone in FBUZ takes about 30 calendar days.

What to pay attention to

If discrepancies with the sanitary legislation and / or the required MPC / MPD indicators are identified in the proposed project of the sanitary protection zone, the customer is issued conclusion on the non-compliance of the project accepted sanitary and epidemiological standards.

Submission of an incomplete or incorrectly executed package of documents (diverging from the regulatory framework) entitles the FBUZ to legally refuse to accept and process documentation.

Attention. After eliminating the comments, it is necessary to go through the approval procedure at the FBUZ again.

FBUZ legally refuses to provide public services if the data about the customer does not match the data contained in the Unified State Register of Legal Entities or the EGRIP or in the absence of materials about the subjects in the above sources.

In the absence of complaints from the FBUZ, the customer firm, upon completion of the examination, receives expert opinion on compliance existing sanitary rules and regulations.

Approval of the SPZ project in Rospotrebnadzor


For further approval of the documentation, the company is sent to the Office of Rospotrebnadzor for the federal district where it is registered. Location Office for St. Petersburg: st.   1. conditions for the design and operation of the sanitary protection zone;

The applicant sends the following documents:
  1. Application for the issuance of a sanitary and epidemiological conclusion, filled out in accordance with the form and including information about the customer of the project (official name, address of registration of a legal entity / individual entrepreneur, TIN, OGRN), about the project developer, a list of attached documents;
  2. Data from the Unified State Register of Legal Entities or EGRIP confirming the registration of the customer in the Russian Federation, in addition to data from the Federal Tax Service required for consideration by the Federal Tax Service and other participants involved in the provision of the service;
  3. Expert opinion obtained as a result of a study carried out by FBUZ;
  4. Companies of hazard categories I and II (with the exception of livestock, poultry farms and cemeteries) also assess the potential risk to the health of exposed people through calculations.
Please note that the project volume is no longer required at this stage of approval.

Options for submitting a package of documents:

  1. Personal appearance at the local Rospotrebnadzor on the set days and hours of admission.
  2. Postage indicating the value of the letter and an inventory (listing and designation of cost) of the attached documentation.
  3. An electronic appeal implemented through the portal "Public Services".
  4. Through local centers for the provision of state and municipal services.
When submitting a set of documents, their presence in full, correct execution, content, and reliability are always checked.

How is the agreement

  1. Registration of the application and attached documentation (performed on the day of submission);

  2. Attention. Immediately after submitting the application, the customer is given the opportunity to monitor the progress of the consideration in any form convenient for him (both remotely and when contacting the territorial Rospotrebnadzor).
  3. Sending requests and notifications by Rospotrebnadzor to the authorities involved in the provision of services (FTS, other subordinate authorities of Rospotrebnadzor).

The state service for issuing a sanitary and epidemiological conclusion for a project is provided free of charge.

According to the regulation on the issuance of sanitary and epidemiological conclusions, adopted by the Order of Rospotrebnadzor dated July 18, 2012 N 775, the approval of the SPZ in this instance takes about 30 calendar days in case of a personal appearance and about 20 calendar days in the case of an electronic request, of which:

  • no more than 5 working days - reconciliation of customer data with the data of the Unified State Register of Legal Entities / EGRIP;
  • no more than 10 working days - verification of compliance with these hygienic standards of design calculations of the negative impact of chemical, biological, physical factors on nature and humanity; analysis of the results of assessing the risk of damage to the health of citizens;
  • no more than 7 (for electronic placement of documents - within 5) working days - administrative formalities (drawing up an official sanitary and epidemiological report on a standard form).
As a next step, the conclusion is submitted for approval to the Chief State Sanitary Doctor of the Russian Federation (for production facilities and facilities of categories I and II), or to the Chief State Sanitary Doctor of a constituent entity of the Russian Federation (for other companies). The approved conclusion is returned to Rospotrebnadzor, where the holograms are pasted and sealed with the official seal. Upon readiness of the conclusion, the customer is notified via the preferred communication channel. So, according to the results of the first two stages of coordination, the company has sanitary and epidemiological conclusion for the project of its calculated sanitary protection zone. When submitting documentation that is not complete or not drawn up in accordance with applicable law, Rospotrebnadzor legally refuses to accept them. Lack of an entry about the customer company in the Unified State Register of Legal Entities / EGRIP, as well as the unreliability of any information contained in the documentation, are legitimate grounds for denial of public services.

Approval of the report on confirmation of the sufficiency of the SPZ

A year after receiving the sanitary and epidemiological conclusion, the third stage of approval takes place - assessment of the adequacy of the theoretical boundaries of the sanitary protection zone by monitoring factors that have a destructive effect on the environment.

The monitoring schedule is drawn up by an ecologist of the developer organization, implemented by a third-party accredited laboratory throughout the year, seasonally. Measurements are made at the border of the estimated SPZ.

The monitoring results are documented in the protocol of observations and entered into the project. Further, according to the protocol, the project development company writes a report confirming the satisfaction or insufficiency of the initially established value of the protective zone. The report and additional documents confirming the implementation of environmental measures (if such measures were provided for by the project) are again sent to the territorial Rospotrebnadzor, where, after 30 calendar days, the final sanitary protection zone is established. In some cases, Rospotrebnadzor asks to first "drive" the report through the FBUZ. Then, after receiving an expert opinion, the document is sent to Rospotrebnadzor, which finally issues an opinion.

The coordination of the SPZ ends with the choice of a variant (calculated or actual) of the sanitary protection zone, which to a greater extent guarantees the protection of nature and society.

What you should pay attention to

Your sanitary protection zone, as well as the documents received upon approval, remain valid until:
  • the field of activity of your company and, as a result, the category of danger does not change;
  • does not change the size of the production capacity and / or technological processes, and with it the amount of hazardous substances produced;
  • the composition of the used fuel, raw materials, and hence the composition and amount of emissions does not change.
It is necessary to reissue the sanitary and epidemiological conclusion when reorganizing, changing the name, changing the actual address, or an error found in a previously issued conclusion.

Sanitary and epidemiological examinations, examinations, studies, tests and toxicological, hygienic and other types of assessments for the purposes of state sanitary and epidemiological supervision, licensing, social and hygienic monitoring are carried out free of charge on the basis of instructions from the chief state sanitary doctors or their deputies, as well as definitions issued by officials in accordance with the Code of Administrative Offenses of the Russian Federation.

In other cases, these examinations, studies and types of assessments can be carried out at the request of citizens, individual entrepreneurs, legal entities, public authorities on a contractual basis.

The term of carrying out is determined depending on the type and volume of studies of a particular type of product, type of activity, works, services and cannot exceed two months. The results are drawn up in the form of an expert opinion, an examination report, a research (test) protocol.

The procedure for issuing sanitary and epidemiological conclusions has been established. The lists of types of products and activities for which these conclusions are issued have been expanded. Thus, sanitary and epidemiological conclusions are also required for activities related to the collection, use, neutralization, transportation, disposal of hazardous waste and for anti-icing reagents.

The list of types of products for which sanitary and epidemiological conclusions are issued exclusively by the head and deputies of Rospotrebnadzor additionally includes: herbal teas, raw materials for the production of baby food, including medicinal plant raw materials, dietary fiber; energy drinks (non-alcoholic, low alcohol), plant extracts for use in the food industry. Perfumes and cosmetics are excluded from this list.

In addition, the procedure for maintaining a register of sanitary and epidemiological conclusions on the compliance (non-compliance) of activities (works, services), products, project documentation with the requirements of state sanitary and epidemiological rules and regulations has been established. The Registry information is publicly available and posted on a weekly updated specialized search server on the Internet.

Order of the Federal Service for Supervision of Consumer Rights Protection and Human Welfare of November 21, 2005 N 776 "On Sanitary and Epidemiological Expertise of Types of Activities (Works, Services), Products, Project Documentation" was declared invalid.
