What does "Overtaking prohibited" mean?

Based on traffic regulations, “no overtaking” prohibits all types of vehicles from overtaking.

This sign has a limited coverage area to prohibit overtaking. As a rule, its effect can only end in the following cases:

  • if a special sign is installed, which means the end of the coverage area of ​​either this sign or all restrictions;
  • in cities and towns, its effect ends after the first intersection.

There are many examples in life when after the installed signs there are not any of these signs and there are no intersections at all. Then, in a populated area, the overtaking ban will automatically end when leaving it. As a rule, there will be a sign “end of settlement”.

What fines can there be?

Any overtaking committed on a section of the road where the “overtaking prohibited” sign is installed and in effect is a clear violation of traffic rules, for which a traffic police officer will issue a fine. Depending on the conditions and situations on the road, the size of the fine may vary.

Let us analyze the main situations that occur with this established sign.

1. Overtaking under a sign and entering the oncoming lane.

If, while driving, the driver makes a maneuver in which a vehicle is overtaken and enters the oncoming lane, then the violation will be clearly classified by the traffic police inspectors under Part 4 of Article 12.15.

As a result, the driver will remain without a driver’s license for up to six months (4-6 months), or, in rare cases, will be required to pay a fine of 5 thousand rubles.

If this maneuver is filmed, the driver will avoid deprivation of his license and will only get off with a fine.

2. Overtaking due to avoidance of an obstacle.

It often happens when there is a vehicle accident on the road or water supply repair work is carried out by utility services, and if there is an opportunity to go around them on their side, drivers overtake in the lane.

For this overtaking, the driver will receive a fine of 1000 or 1500 rubles.

3. Overtaking in the absence of markings.

If the driver overtakes on a section of the road where there are obviously no markings and the maneuver is made not in the oncoming direction, but in the middle of the road (provided that the width of the road in each direction is approximately at least 4-5 m), then a fine will be imposed on the traffic violator will be only 500 rubles (Article 12.16 part 1).

  • “Before overtaking, the driver must ensure that the lane he is about to enter is clear at a sufficient distance for overtaking and that in the process of overtaking he will not create a danger to traffic or interfere with other road users.”

If an accident occurs, the overtaking person will be at fault by default. An exception to the rule is contained in clause 11.3 of the Traffic Regulations:

  • "11.3. The driver of an overtaken vehicle is prohibited from impeding overtaking by increasing speed or other actions.”

If it turns out that the driver of the vehicle in front deliberately interfered with overtaking, which resulted in an accident, then he will be found guilty. Despite the absurdity of the situation, the network is full of videos where motorists who are especially offended by overtaking, preventing overtaking, create dangerous situations not only in the city, but also on highways. They often do this quite legally, using clause 11.2. Traffic regulations:

  • “The driver is prohibited from overtaking in cases where:
  • The vehicle ahead is overtaking or avoiding an obstacle.
  • A vehicle ahead in the same lane signaled to turn left.
  • The vehicle following him began to overtake.
  • Upon completion of overtaking, he will not be able, without creating a danger to traffic and interference with the overtaken vehicle, to return to the previously occupied lane.”

It is enough to pretend that you are going to overtake by turning on the left turn signal, and now you can no longer be overtaken. The overtaking person must see where he can fit into “his” lane.

○ Where is overtaking prohibited?

Some drivers are sure that you cannot overtake only if you have to cross a solid marking line, in fact, clause 11.4. The traffic rules provide a list of places where overtaking is prohibited:

  • “Overtaking is prohibited:
  • At signalized intersections, as well as at uncontrolled intersections when driving on a road that is not the main one.
  • At pedestrian crossings.
  • At railway crossings and closer than 100 meters in front of them.
  • On and under bridges, overpasses, overpasses, as well as in tunnels.
  • At the end of a climb, on dangerous turns and in other areas with limited visibility.”

If everything is very clear with the ban on overtaking at pedestrian crossings and crossings, then with intersections everything is a little more complicated. In any case, it is prohibited at a controlled intersection.

On an unregulated road, only vehicles moving on the main road can be overtaken, provided that it is not a four-lane road. In this case, it will be marked with special signs 2.1, 2.3.1 - 2.3.7.

As for bridges, you need to be careful. They will not necessarily be marked with special signs, but, nevertheless, you should not overtake under them.

You must not overtake at the end of a steep hill or in a closed corner. They are indicated by signs 1.14, 1.11.1 and 1.11.2.

One of the most difficult issues is overtaking in low visibility conditions, but what is “low visibility”? Clause 1.2 of the Traffic Regulations gives a rather vague definition:

  • ““Limited visibility” is the driver’s visibility of the road in the direction of travel, limited by the terrain, geometric parameters of the road, vegetation, buildings, structures or other objects, including vehicles.”

Visibility on the road may become limited at any time due to changes in the road situation and the location of vehicles. In such conditions, overtaking becomes an extremely dangerous maneuver, which means it is better to abandon it.

Please note that overtaking along the entire length from the exit from the occupied lane is considered uniform, and therefore it should begin and end only on permitted sections of the road.

And of course, in no case should you ignore the markings when crossing a solid line or “no overtaking” signs. Any of these violations are punishable by a serious fine.

○ Fines for illegal overtaking.

The Code of Administrative Offenses does not contain a separate fine for each of the possible cases of violation of the rules when overtaking. But for any of them the culprit will be held accountable under Parts 4 and 5 of Art. 12.15 Code of Administrative Offences:

  • "4. Driving, in violation of the Traffic Rules, onto a lane intended for oncoming traffic, or onto tram tracks in the opposite direction, except for the cases provided for in Part 3 of this article, shall entail the imposition of an administrative fine in the amount of five thousand rubles or deprivation of the right to drive vehicles for a period of from four to six months."
  • "5. Repeated commission of an administrative offense provided for in Part 4 of this article - entails deprivation of the right to drive vehicles for a period of one year, and in the case of recording an administrative offense using special technical means operating automatically, having the functions of photography, filming, video recording, or photo means. and filming, video recording - imposition of an administrative fine in the amount of five thousand rubles.”

This happens because now any overtaking means entering the lane of oncoming traffic.

Some drivers are sure that 5000 RUR fine under clause 4 of Art. 12.15 of the Code of Administrative Offences, they are threatened only for overtaking under a prohibitory sign or crossing a solid road. In fact, it can be applied for any of the described violations. That is, it is enough to start overtaking, interfering with other vehicles in order to lose your license for 4 – 6 months.

Secondary violation guaranteed will cost a driver's license for a year if you are noticed by a traffic police inspector. If the driver gets caught on camera, he will receive a “letter of happiness” with a fine of 5000r.

If the traffic police inspector recorded the violation on camera, he will also record the violation and will take the case to court for deprivation of rights, since in this case the recording is simply evidence. And it doesn’t matter that the last time you were fined for incorrectly avoiding an obstacle or simply driving in the oncoming direction, the violation will be considered a repeat violation.

Traffic on the road cannot exist without overtaking, but it must be done correctly, then you will not have to be held accountable for violating traffic rules. In 2019, the concept of overtaking is characterized by the advance of one vehicle or several at once, when the driver drives a car from the designated lane into the oncoming lane and returns back to his lane.

What has changed in the legislation:

  1. If earlier overtaking was considered to be ahead of a car that is moving, today there is no such clear wording in the law. Therefore, even if a car is at the side of the road in the lane, and another one goes around it, moving into the oncoming lane, this can also be positioned as overtaking.
  2. Sometimes it is impossible to avoid driving into the oncoming lane, but this is only allowed on specially designated sections of the road route where there is no prohibition on crossing. For example, if a road consisting of 2 lanes does not contain a double solid line.

Overtaking requirements in 2019

Overtaking is dangerous because when driving into the oncoming lane, there is a possibility of a collision with other road users.

When you can't overtake

The traffic rules clearly describe situations when overtaking other cars is strictly prohibited:

  1. If you are standing at an intersection, whether it is controlled or not. Why? Because it is at intersections that a huge number of accidents are registered.
  2. Pedestrian crossings are not a place for maneuvers. A pedestrian may react incorrectly to overtaking and become confused. But even if there are no pedestrians nearby, you still cannot overtake cars.
  3. High-risk areas are considered to be railway crossings and a distance of 100 m from them. A distance of 100 m before and after the crossing is taboo for drivers to overtake.
  4. The same applies to overpasses, tunnels, bridges, and overpasses passing directly under them. Visibility here is so limited that it is very difficult for the car owner to navigate the free distance.
  5. Each route has dangerous turns - they can be sharp or rush upward, that is, the road surface is absolutely not visible. At such turns, it is recommended to slow down and be extremely careful, otherwise there is a risk of a head-on collision.

Where is it prohibited to overtake?

According to paragraph 11.4 of the traffic rules, you cannot make an overtaking maneuver on the following sections of the roadway:

  • at regulated and unregulated intersections of non-main roads;
  • at crossings equipped for pedestrians, if there are people on them;
  • where railway crossings are located (within 100 meters from their location and directly on them);
  • in a tunnel, on a bridge, overpass, overpass and under them;
  • where the ascent ends;
  • in places where visibility is limited.

If we refer to Article 11.2 of the Traffic Regulations, overtaking is prohibited under the following circumstances:

  • overtaking or going around an obstacle by a car that is ahead of an overtaking vehicle;
  • the vehicle ahead turns on the left turn signal;
  • overtaking by the driver of a vehicle located behind;
  • inability to return to the original lane without interference for other motorists.

Sometimes there is a violation of the “Overtaking prohibited” sign without a continuous marking line. In this case, you really cannot overtake according to the sign. The dotted markings allow you to turn around or turn around.

If we talk about the fine for overtaking on a bridge, then when assigning a punishment, mitigating circumstances are taken into account: committing a violation for the first time, poor-quality markings and the presence of slow-moving vehicles ahead.

One of the most common violations is overtaking on the right. According to Article 11.2 of the Traffic Regulations, it is permissible to overtake a trackless vehicle on the left side. The exception is the case when the car moving in front turned on the left turn signal and began to perform the indicated maneuver.

It looks the same as the “Overtaking is prohibited” sign, only with a thin strip crossing out the cars depicted on the sign.

So, for example, if a sign is installed at a turn followed by an intersection, then, according to the overtaking rules, the driver will be prohibited from overtaking another vehicle only at the turn. After the intersection, he can overtake correctly (if there is a broken line, there are no vehicles in the oncoming lane, and no one is trying to overtake from behind).

If the driver encounters a “No Overtaking” sign while outside a populated area, then upon entering the populated area, the prohibition sign ends. At the beginning of a populated area there is always a corresponding “Beginning of a populated area” sign.

If the driver is “caught” overtaking (recorded by photo or video recording devices), he will be issued a fine.

In this case, the size of the fine will directly depend on the place where the maneuver was made, ignoring the overtaking rules.

What determines the size of the fine?

Overtaking under a sign and driving into oncoming traffic, according to Article 12.15 of the Code of the Russian Federation on Administrative Offences, can lead to a fine of five thousand rubles or deprivation of the right to drive a vehicle for a period of four to six months;

The latter measure of punishment is possible only if the violation is recorded on a video recording device.

One hundred percent deprivation of a driver's license is possible if the driver entered the oncoming lane in a place where overtaking is prohibited, and collided with one of the cars.

An even more aggravating circumstance may be the death of one of the traffic participants (driver, passengers, pedestrians).

  • Entering the oncoming traffic lane through a double solid lane, if you want to go around some kind of obstacle (which is located on the left), if possible, go around it on the right.

Thus, the driver violates three rules at once: he ignores continuous markings, drives into oncoming traffic, and creates an obstacle for oncoming traffic.

Example: a driver saw an obstacle on his way (a broken down car with the hazard lights on, for example) and decided to go around it. According to the rules of the road, this must be done, according to the rules of overtaking, on the left side in the lane of passing traffic. Quite often, drivers simply do not understand that they have entered the lane of oncoming traffic in a place where overtaking is prohibited, because there are no markings separating the traffic flows. However, ignorance will not relieve the offending driver from the obligation to pay a fine in the amount of five hundred to one thousand rubles.

When can you avoid a fine for overtaking?

  • Horse-drawn carts (trailer pulled by animals);
  • Mopeds;
  • Motorcycles (only if it does not have a sidecar);
  • Other vehicles with a sign indicating low-speed driving;

Drivers are capable of performing many different maneuvers, but the biggest danger is overtaking. Often, drivers may be inattentive, fail to adhere to the marking line, and perform maneuvers that do not comply with the signs. Such maneuvers often lead, at best, to fines or withdrawal of rights, and at worst, to the creation of fatal accidents.

Effect of the “Overtaking” sign

Based on its name, it is prohibited to overtake vehicles, except:

  • slow-moving;
  • horse-drawn;
  • bicycles;
  • mopeds;
  • two-wheeled motorcycles.

They place it mainly in places where:

  • there is a high risk of collision with other vehicles;
  • lack of visibility for vehicles moving in the opposite route;
  • there is a settlement.

The validity of the sign will be terminated if the following symbols are available:

  • indicating that the no-overtaking zone has ended;
  • indicating the presence of a certain number of restrictions and their termination;
  • indicating the duration of the unsafe section will be installed in a populated area or in the presence of such a section of the road under a sign that prohibits overtaking.

What is a slow-moving vehicle and how to identify it?
This includes mechanically driven vehicles, the speed of which cannot be higher than thirty kilometers per hour due to technical reasons.

Administrative liability is provided for such actions (Article 12.15 of the Administrative Code). What is the fine for overtaking under a prohibitory sign? It can be either in monetary terms, or often deprived of rights for this violation.

In what cases is there punishment?

  1. If you drive in the oncoming lane or onto tram tracks (point 4), a fine of 5,000 rubles will be imposed. or it is quite likely that you will be deprived of your license for overtaking under a prohibitory sign for four to six months.   4. When crossing a solid line, the punishment will be clear. Only if there are obstacles that cannot be avoided on the right side, the penalty will be assessed in accordance with Part 3 of the article and amount to 1000-1500 rubles. fine

In what cases is overtaking possible, even if there is a prohibiting sign and a solid marking line? There may be several options:

  1. If there is a slow-moving vehicle ahead with a corresponding triangular sign.
  2. If the transport is other than slow-moving vehicles that can be overtaken.

In any other cases, if continuous markings are drawn and there is a sign prohibiting overtaking, doing so is strictly prohibited and is punishable by deprivation of rights or imposition of fines, depending on the situation.

This sign looks exactly the same as the no-overtaking sign, only on a yellow background. It is installed during road repair work. If there is a contradiction between a temporary and an ordinary sign, it is necessary to navigate according to the temporary one.

There are two signs along the road: the main one, stating that all restrictions are no longer in effect, and a temporary sign prohibiting overtaking. How to avoid deprivation of your license for overtaking under a prohibiting sign

There are some exceptions to the 2015 rules where you can overtake at a “No Overtaking” sign. This is allowed in the following cases.

  1. If a slow-moving vehicle with a specially installed sign on it is traveling in the same direction.
  2. If a horse-drawn or horse-drawn carriage is driving in front of the driver.
  3. If there is a motor vehicle with two wheels ahead.

"Overtaking"- advance of one or more vehicles associated with entering a lane (side of the roadway) intended for oncoming traffic, and subsequent return to the previously occupied lane (side of the roadway).

Rules for overtaking, ahead, oncoming traffic:

11.1. Before overtaking, the driver must make sure that the lane he is about to enter is clear at a sufficient distance for overtaking and that in the process of overtaking he will not create a danger to traffic or interfere with other road users.

11.2. The driver is prohibited from overtaking in the following cases:

  • the vehicle moving ahead is overtaking or avoiding an obstacle;
  • a vehicle moving ahead in the same lane has signaled a left turn;
  • the vehicle following him began to overtake;
  • upon completion of overtaking, he will not be able, without creating a danger to traffic and interference with the overtaken vehicle, to return to the previously occupied lane.

11.3. The driver of an overtaken vehicle is prohibited from impeding overtaking by increasing speed or other actions.

11.4. Overtaking is prohibited:

  • at controlled intersections, as well as at unregulated intersections when driving on a road that is not the main one;
  • at pedestrian crossings if there are pedestrians on them;
  • at railway crossings and closer than 100 meters in front of them;
  • on bridges, overpasses, overpasses and under them, as well as in tunnels;
  • at the end of a climb, on dangerous turns and in other areas with limited visibility.

11.5. The advance of vehicles when passing pedestrian crossings is carried out taking into account the requirements of paragraph 14.2 of the Rules.

11.6. If, outside populated areas, overtaking or ahead of a slow-moving vehicle, a vehicle transporting large cargo, or a vehicle moving at a speed not exceeding 30 km/h is difficult, the driver of such a vehicle must take as far to the right as possible, and if necessary stop to allow following vehicles to pass.

11.7. If oncoming traffic is difficult to pass, the driver on whose side there is an obstacle must give way. The driver of a vehicle moving downhill must give way in the presence of an obstacle on slopes indicated by signs 1.13 and 1.14.

3.20 “Overtaking is prohibited.”

Overtaking of all vehicles is prohibited, except for slow-moving vehicles, horse-drawn carts, mopeds and two-wheeled motorcycles without sidecars.
