Preface

The original text of the Town Planning Code of the Russian Federation (GrK RF) was published in " Rossiyskaya newspaper"(N 290, 12/30/2004), "Collected Legislation of the Russian Federation" 01/03/2005, N 1 (part 1).

The procedure for applying the Civil Code of the Russian Federation is established by Federal Law dated December 29, 2004 N 191-FZ "On the entry into force of the Town Planning Code of the Russian Federation"

The Civil Code of the Russian Federation is one of the most dynamically changing laws, to which, since its adoption, dozens of amendments have been made.

Town Planning Code of the Russian Federation– complex legislative act, designed to regulate relations in the areas of:

  • territorial planning,
  • urban planning zoning,
  • territory planning,
  • design and construction of facilities capital construction, their reconstruction, major repairs, as well as the operation of buildings, structures,
  • ensuring the safety of construction, operation of buildings, structures, prevention emergency situations natural and technogenic nature and eliminating their consequences,
  • acquisition, termination of SRO rights in the area engineering surveys, architectural and construction design, construction, reconstruction, overhaul capital construction projects for the issuance of certificates of admission to engineering survey work, preparation project documentation, for construction, reconstruction, major repairs of capital construction projects that affect the safety of capital construction projects,
  • creation of artificial land plots and construction of capital construction projects on such land plots.

GRK RF is the leading law in its field public relations and according to paragraphs. 3, 4, Article 3 of the Civil Code of the Russian Federation, laws and other regulations legal acts subjects of the Russian Federation and municipal authorities self-government containing norms regulating relations in the field urban planning activities, cannot contradict the Town Planning Code of the Russian Federation.

Other (related) legislation applied in urban planning activities may, for example, include the Civil Code of the Russian Federation, the Code of Administrative Offenses of the Russian Federation, Water Code Russian Federation, Forest Code of the Russian Federation, Federal Law "On the sanitary and epidemiological welfare of the population" and other laws. Relations related to urban planning include primarily land relations regulated by the Land Code of the Russian Federation.

"22" December 2004 State Duma this universal codified legal act regulating relations in the field of urban planning activities in the Russian Federation. The document was signed by the current president of the country and came into force on December 30, 2004. The above-mentioned act completely replaced the Civil Code of the Russian Federation of 1998.

Structure of the Town Planning Code of the Russian Federation

The structure of the Town Planning Code of the Russian Federation in 2017 includes 11 chapters consisting of articles. The articles regulate and regulate the urban planning industry in all constituent entities of the Russian Federation.

  • The first chapter of the Town Planning Code of the Russian Federation of this document contains general provisions, describes the participants in the relationship, whose rights and obligations are discussed in the document, deciphers the terms and concepts used, and gives an idea of ​​the objects of urban planning.
  • The second chapter of the code is entirely devoted to the powers of bodies and officials, including federal and local government, governing bodies and local committees.

Subject of legal regulation by the Civil Code of the Russian Federation

The main regulatory legal act of Russian town planning legislation identifies the following objects for regulating relations.

Urban planning relations. These include any legal relations, in one way or another related to the field of urban planning - activities for the development of cities and other types of settlements, including territory planning, zoning, architectural and construction design, construction of new facilities, repair and reconstruction of existing ones, and others.

Relations defining the rules for ensuring construction safety and eliminating the consequences of emergency situations.

Job self-regulatory organizations(SRO). Including rules for opening, closing, and areas of activity of SROs.

Rules and regulations relating to the creation of artificial land plots and new territories.

All organizations, services, enterprises and responsible persons related to the urban planning industry. Including foreigners and stateless persons, unless otherwise specified in the articles of this document.
