According to the letter of the Ministry of Labor of Russia dated November 2, 2016 No. 15-2/ОOG-3886, the current legislation of the Russian Federation does not provide for requirements related to the extension of the period of wearing PPE depending on the time the employee performs work.

At the same time, the letter noted that, in accordance with paragraph 22 of the Intersectoral Rules for Providing Workers with Special Clothing, Special Footwear and Other Personal Protective Equipment, PPE returned by workers after the expiration of their socks, but suitable for further use, is used for its intended purpose after taking measures to care for them ( washing, cleaning, disinfection, degassing, decontamination, dust removal, neutralization and repair). The suitability of the specified PPE for further use, the need to carry out and the composition of measures to care for it, as well as the percentage of wear of the PPE are established by an official authorized by the employer or the labor protection commission of the organization (if any) and are recorded in the personal record card for the issuance of PPE.

In this case, the wearing period of the specified PPE should not exceed the shelf life (for PPE that loses its protective properties during storage) or the expiration date, warranty period provided for by the markings applied to the product packaging, as well as the operational documentation for the PPE.

For example, these are robes, overalls, trousers, suits, sheepskin coats, padded jackets, mittens, etc. In order to correctly write off objects, you need to know the service life of workwear - the standards are regulated at the legislative level. Let's take a closer look at the nuances of accounting for special clothing.

What is the service life of workwear: standards

Accounting for workwear in organizations is regulated by Order of the Ministry of Finance of Russia No. 135n dated December 26, 2002 (hereinafter referred to as the Order). The general list of such items is defined in clause 5 of the Order, including both safety footwear or workwear, and individual devices. The specific needs of each enterprise are determined individually, based on the specifics of the activity. Items can be written off immediately upon release (transfer) to personnel in the case where the wear period does not exceed 1 year (clause 21 of the Order). If the clothing is in use for more than 12 months, write-off of the fixed asset (fixed asset) is carried out during the useful life (useful life) using the straight-line method (clause 26 of the Order).

The minimum terms and procedure for using workwear are given in the Standard Standards for the relevant sectors of the economy, as well as in the Rules for Decree No. 51 of December 18, 1998 (clause 26 of the Order). In some cases, enterprises have the right to approve their own increased standards, corresponding to the results of the special assessment and assessment, and also change some protective equipment to others in agreement with the state inspector for labor protection of employees (clauses 5, 6 of the Rules).

How to determine the service life of workwear

To approve the standards, the employer must adopt an order or other administrative document, or enter the appropriate values ​​into the local acts of the enterprise. When establishing your own indicators that differ from the normative ones, it is not allowed to reduce the number of write-off units required. Wearing period for workwear - norms in certain industries:

• For trade– issuance standards were approved in the resolution of the Ministry of Labor dated December 29, 1997 No. 68 (Appendix No. 7). For example, in retail and warehouse enterprises, a picker is entitled to 4 pairs of gloves when working in a warehouse, and in catering, a kitchen worker is entitled to 2 pairs.
• For chemical production– values ​​​​are approved in the order of the Ministry of Health and Social Development No. 906n dated 08/11/11. In particular, the electrician of the brigade is entitled to one suit/helmet for 2 years of work, as well as a pair of shoes and boots, 6 pairs of gloves, dielectric galoshes until completely worn out and other types of workwear according to standard standards.

Write-off of workwear in tax accounting is carried out against the material costs of the enterprise on the day of transfer to the employee (subclause 3, clause 1, Article 254 of the Tax Code) or in equal amounts within the total period of the personal investment account. The period of use of workwear in production is regulated by the Government of the Russian Federation. The period for which special clothing is issued is specified in the Labor Code, and different service periods are provided for different types and purposes of equipment.

The Labor Code also determines the requirements for special clothing and the types of activities where its use is necessary. These types of activities include production, where the employee regularly encounters harmful factors that cannot be eliminated by administrative or engineering methods.

It is worth noting that the employer must, at his own expense, provide replacement workers in a timely manner. If workwear is damaged due to the employee’s negligence or improper use, he must purchase a new set himself and use it until the planned replacement at the enterprise.

Service life of special clothing depending on climate

Cold climate zones are divided into 5 categories (climatic zones). In such areas, in addition to protective equipment, if necessary, the employer must provide employees with.

Features of issuing workwear in production

The terms of use of workwear vary for different professions, positions and areas of activity. For example, electricians receive 12 pairs of gloves per year.

If the profession is not directly related to production, then the replacement of workwear occurs less frequently. For example, engineers and foremen in the field of electrical installation receive only 3 pairs of gloves per year.

Separately, there are helmets for protection from mechanical damage. They are issued for an unlimited period and are replaced only if damaged. Along with the helmet, the worker receives a balaclava, which is changed once a year, and an insulated balaclava for the winter season, which is worn for 2 years.

A prerequisite for issuing workwear is the appropriate size. Clothing should not restrict the worker's movements, which could lead to a dangerous situation.

Duration of use of workwear in everyday life

If you use workwear at home, for example, to do housework, then the period for wearing such workwear is determined by you personally.

The exception is protective equipment - for your own safety, it must always meet the standards and be replaced if any damage occurs. In addition to this condition, the service life of workwear for personal use is unlimited.

The workwear is one of the options for personal protective equipment. It was designed to help keep people safe when performing specific job duties. In addition, special clothing is a means of communication between an enterprise and the end consumer, demonstrating the attributes of corporate style.

Modern workwear is divided into three different types depending on the functions it performs. The first type is corporate workwear. It is designed to strengthen the corporate spirit within the team, as well as demonstrate the company’s brand.

The second type of workwear is called signal It is made from special materials that reflect light and is most often used by road workers to warn drivers.

The last type of workwear is called protective. It is used for work involving high temperatures, protects a person from possible injuries and is waterproof.

Workwear can also be distinguished by other principles:

1. Summer special clothing. This type of uniform allows a person to work even in high temperature conditions. In the production process of such clothing, special materials are used that are breathable, light, and hygroscopic. At the same time, the main purpose of this form remains the same - to provide protection to workers. Typically, summer workwear includes overalls, bib overalls, trousers, and a company suit.
2. Winter special clothing. It is designed to allow people to work in low temperatures. At the same time, despite the insulation, this form should not hinder movement and weigh a lot. It usually includes insulated trousers, overalls, jackets, and vests. Often the winter uniform has not only a protective, but also a signaling function. For this purpose, it is equipped with reflective inserts.
3. Special clothing for tourism and fishing. This version of the uniform can be either summer or winter. It should not interfere with movement and ensure safety. Often this uniform is made from camouflage fabric (especially for the summer version).

The need for special clothing is ensuring human security. Especially special uniforms are needed for people who work or otherwise come into contact with the external environment (in other words, spend a lot of time outside). Such people usually require both a summer (to protect against the heat) and a winter (to protect from the cold) uniform.

Issuance standards by profession for 2020

The Labor Code of the Russian Federation has provisions, which provide safe working conditions. For example, if the work process is associated with harmful or dangerous working conditions, the employer is obliged to provide employees with protective equipment, as well as special clothing.

The standards for issuing uniforms for workers are reflected in Order of the Ministry of Labor of Russia No. 997n. This document presents list of norms, for which special clothing is issued for 195 specialties. It includes 14 sections, the first of which regulates the following standards:

• issuance of personal protective equipment to workers of cross-cutting specialties in any economic sector;
• issuance of warm workwear and footwear taking into account the climate of a particular region;
• issuing a special form with reflective elements that increase visibility.

The remaining sections of the order explain to employers what standards are applied in the process of issuing workwear to workers of various specialties in such areas of the national economy as:

• fish farming and agriculture;
• processing and mining;
• woodworking industry (including printing, paper production, etc.);
• chemical industry;
• production of machinery, machine tools and metallurgical products;
• industry related to the creation of electrical equipment, optical instruments, and electronics;
• supplies of gas, water, energy;
• building sector;
• communications and transport;
• industry related to trade, finance, services;
• public services, defense department;
• scientific, cultural, sports sphere.

If an employer refuses to provide his employees with personal protective equipment and workwear, he faces serious penalties. In case of repeated violation of the ministry's order the business may be closed for up to 95 days, and the fine will be equal to 2 million rubles.

The service life and operation of special clothing is established by the standards reflected in the Labor Code of the Russian Federation.

It defines types of equipment, as well as those presented to it requirements. This document also states that special clothing and protective equipment for workers must be purchased by the employer.

Standards for the use of workwear depend on the employee’s specialty, climatic conditions, as well as the professional characteristics of a particular sector of the national economy. For example, winter uniforms are divided into four categories:

• 1 category. Includes a jacket and trousers with insulated lining and special membrane inserts. The form is issued for three years, after which it must be replaced. Winter boots are issued every four years.
• 2nd category. In this case, the jacket is issued for two and a half years, and shoes for three.
• 3 category. The clothing is not provided with membranes, but is lined. Changes once every two years. The boots are issued for two and a half years.
• 4th category. The jacket needs to be changed every year and a half, and shoes - every two years.

Enterprise employees need to remember that the service life of workwear largely depends on the employee himself. Uniforms must be cleaned and repaired promptly. Much also depends on storage conditions. This is a very important condition, on which the safety and health of a particular worker also depends.

List of freely issued protective clothing, footwear and personal protective equipment

According to the legislation of the Russian Federation, the employer hiring personnel must provide them with special clothing, footwear, and personal protective equipment.

What specific workwear does the employee receive? determine intersectoral charters. Here list of items, which the employee receives free of charge depending on his specialty:

Deduction of cost upon dismissal

Upon dismissal from the enterprise, the employee is obliged to return the protective clothing he received to the warehouse. If he did not do this (for example, things were lost), he will have to pay the amount of damage from his own salary. This is stated in the Labor Code of the Russian Federation in Article 243.

The law states that the payment is determined taking into account the market value of a particular property at a given time.
