Regulations on personal affairs of students .

I . General provisions.

1.1. These Regulations were developed to regulate the work with personal files of school students and determine the procedure for all categories of school employees involved in working with this documentation.

1.2. This Regulation is approved by a school order and is mandatory for all categories of teaching and administrative employees of the school.

1.3. A student’s personal file is a mandatory document that is issued for each student from the moment he or she enters school and is maintained until graduation.

1.4. Personal files of students are maintained by class teachers.

II . Contents of students' personal files.

2.1. The student’s personal file is an individual folder with files containing the student’s personal card (printed personal file form), and other attached files with other documents, in accordance with this provision.

2.2. The following are in the personal file:

III . The procedure for registering personal files.

3.1. When a student enters 1st grade, the class teacher

    fills out the student’s personal card (printed personal file form) according to the birth certificate.

If the student arrived from another school, the personal file number is carefully crossed out and a new number is written next to it.

3.2. If the student arrived from another educational institution, the class teacher checks the presence of all seals and grades issued in the previous educational institution, pastes the student’s photo into the personal card, if it is not there; places documents in the personal file in accordance with this provision; checks the personal file for the presence of all documents in accordance with this provision. In the absence of the necessary documents in the personal file, takes measures to complete them.

3.3. For students in grades 10-11 - a statement from parents (legal representatives), a copy of the certificate of basic education

3.4. All information about the student is adjusted by the class teacher as the data changes.

3.5. When changing the name of the school, in the free space of the title page, write in legible handwriting the new name of the school in accordance with the Charter, without abbreviations. The old name is neatly crossed out (so it can be read).

IV . Procedure for conducting personal affairs

4.1. The general folder with personal files of the class on the front side has the inscription: class and academic year. Inside the folder on the cover there is a list of the class in alphabetical order (the list from the KIASOU program can be used); when a student leaves, a mark is made on the list about leaving

4.2. Entries in your personal card must be kept clearly and accurately. In case of erroneous entries, corrections are certified by the signature and seal of the director of the educational institution.

4.3 The class teacher annually enters information about awards, incentives for students, and student achievements. The student’s achievements in individual subjects can be entered by the subject teacher under the guidance of the class teacher

4.4. The class teacher monitors the current state of documents in the student’s personal file; mandatory checks are carried out by the class teacher 2 times a year (September, May)

4.5. At the end of the school year, the class teacher makes annual (final) grades for the subjects of the curriculum, writes down the results of the year (For example, transferred to 3rd grade, retained in 1st grade, graduated from 11th grade), puts his signature, affixes the school seal

4.6. If the names of the subjects of the curriculum are not on the printed (typographical) form, the class teacher enters them into the empty lines of the form in strict accordance with the name of the subject in the curriculum.

4.7. If a student leaves for another educational institution, a record of departure is made in the personal file indicating the future educational institution, the date of departure and is certified by the seal of the school.

V . The procedure for issuing personal files of students upon leaving school

5.1. The personal file is issued to the parents (legal representatives) of the student upon their personal application.

5.2. When issuing a personal file, an entry is made in the alphabetical book about the disposal

5.4. In cases where the departure is formalized during the school period, the class teacher compiles a statement of current grades for this period.

5.5. Upon completion of training, the personal files of 11th grade students are transferred to the school archive, where they are stored for 3 years.

5.6. Upon completion of the 9th grade and with the student’s transfer to another school, a personal file (upon application) is issued to him along with a certificate of basic education.

VI . The procedure for storing and monitoring personal files

6.1. All personal files of the class during training are stored in a common folder in the head teacher’s office.

6.2 Personal files not requested by parents are transferred to the school archive, where they are stored for 3 years from the date the student leaves school.

6.3. Control over the management of personal files is carried out by the class teacher, the head teacher for educational work and the school director.

6.4.Checking of students’ personal files is checked by the head teacher according to the internal school control plan, at least 2 times a year (at the beginning of the school year and at the end of the school year). If necessary, the inspection is carried out unscheduled.

1. GENERAL PROVISIONS.

1.1. Personal files are drawn up by primary school teachers for each student from the moment he or she enters school and are maintained by class teachers until graduation.

1.2. Personal files are kept in the office in a strictly designated place.

1.3. Personal files of students are stored in a common folder indicating the school, class (its letter if there are parallels), f. And. O. class teacher.

1.4. Personal files must be arranged in alphabetical order according to the attached list of students, certified by the class teacher (for the list form, see Appendix No. 1). The lists change annually.

1.5. On the list of students, the class teacher promptly notes the movement of students throughout the year (when and where the student left, when and where he arrived).

1.6. Upon graduation, the student’s personal file is stored in the school archives for 3 years.

2. REQUIREMENTS FOR REGISTRATION OF STUDENTS' PERSONAL RECORDS .

2.1. The student’s personal file must be signed and certified by the signature of the director and the round seal of the school.

2.2. A photograph of the student is affixed to the title page of the personal file. Newly arrived students who do not have a photograph in their personal file are required to provide it within a week from the date of arrival.

2.3. On the back of the personal card, information about the student’s parents and full home address must be written down.

2.4. Final grades and a record of transfer to the next grade (transferred to ___ grade), repeating a year (remained in __ grade), completion of a course of basic general education, complete secondary education (graduated from __ grades) are annually certified by the signature of the class teacher and the round seal of the school.

2.5. In the “foreign language” column, the class teacher must write down the language being studied (for example, English)

2.7. Records in your personal file must be kept clearly and accurately.

2.8. Writing in pencil in your personal file is prohibited.

3. REQUIREMENTS FOR COMPLETING PERSONAL RECORDS.

3.1. When compiling students’ personal files, parents must submit the following documents:

3.2. When compiling personal files, documents for the student are arranged in the following order:

4. RESPONSIBILITIES OF THE CLASS TEACHER FOR REGISTERING PERSONAL RELATIONS WHEN ADMISSIONING STUDENTS TO SCHOOLS.

4.1. The personal file has a number corresponding to the number in the alphabet book (for example, the number K / 5 means that the student is recorded in the alphabet book with the letter K under number 5).

4.2. The class teacher of the first grades must register each student in the alphabetical book with the secretary and assign the corresponding number to the student’s personal file, and must enter the personal file number of each student in the class register, in the column “Information about students.”

4.3. When admitting newly arrived students to school, the class teacher of grades 1-11 must re-register the students’ personal files in accordance with the entry in the alphabetical book.

5. RESPONSIBILITIES OF THE SECRETARY WHEN ISSUING AND ACCEPTING STUDENTS' PERSONAL RECORDS.

5.1. The secretary issues application forms for admission to or withdrawal from the school to parents or students.

5.2. The secretary endorses applications from parents and students in grades 9-11 from the school principal.

5.3. The secretary makes a note in the students' personal files about their departure (when, where, for what reason).

5. 4. The secretary issues personal files of students who have dropped out of school on the basis of a written application from parents or persons replacing them only upon provision of a certificate confirming the place of further education or sends them at the request of a general education institution.

5.5. The secretary notes the departing students in the alphabetical book, promptly prints orders for the departing and arriving students.

5.6. The secretary introduces the parents of newly arrived students to the Charter of the school, documents on licensing and accreditation of the educational institution; with documents regulating the rights and obligations of participants in the educational process, including an agreement between the school and the parents of students.

5.7. The secretary issues one copy of the agreement, signed by the school director and parents, to the parents of newly arrived students. One copy remains in the student’s personal file.

6. CONTROL OF PERSONAL AFFAIRS

6.1. Monitoring the state of personal affairs is carried out by the Deputy Director for Educational Work.

6.2. Checks of students' personal files are carried out according to the internal school control plan at least 2 times a year. In cases of untimely registration of personal files, or detection during a scheduled inspection of non-compliance with the requirements for maintaining personal files by class teachers, the inspection is carried out unscheduled, promptly, and selectively.

6.3. The goals of control are the correct and complete completion of personal files, timely registration.

6.4. Based on the results of the inspection, the deputy director for educational work prepares a certificate indicating comments to a specific person.

6.5. The final certificate is provided to the school director. Based on the results of the certificate, the director has the right to issue an order indicating sanctions for the management of students’ personal files:

For responsible, conscientious and careful management of personal affairs - gratitude;

Note on registration of personal files - a repeat check is scheduled;

Remarks for incorrect and incomplete completion of personal files, untimely registration - the class teacher is placed under the individual control of the deputy director for educational work and provides an explanatory note about the reasons for the unfair attitude towards the management of students’ personal files;

For a systematic and gross violation of the Regulations on the management of personal affairs of students, the director has the right to impose an administrative penalty.

2. The procedure for registering personal files upon admission to school.

Personal files of students are formed by the class teacher upon admission of the student to 1st grade on the basis of a personal statement from parents (legal representatives).

To register a personal file, the following documents must be submitted:

A copy of a document confirming the identity of one of the parents (legal representative);

A copy of the birth certificate;

Certificate of family composition;

Statement from parents (legal representatives) indicating that parents are familiar with the School Charter;

For admission to 10th grade, the following documents are provided:

In the class personal files folder, the class teacher puts a list of the class indicating the last name, first name, personal file number, medical policy and passport number, home address and telephone number, as well as full name. class teacher. The list changes annually. If a student drops out during the school year, a mark of departure is made and the order number is indicated.

When correcting a grade, an explanation is given and the director’s stamp and signature are affixed.

The absence column indicates the number of lessons missed due to illness or without a valid reason.

4. The procedure for issuing personal files of students upon leaving school.

The issuance of a personal file to the student’s parents is carried out by the school director in the presence of an order “On departure”.

The student’s personal file is handed over to parents (legal representatives) upon their personal application.

When issuing a personal file, the director makes an entry in the alphabetical book about the departure, and the parents (legal representatives) of the student put their signature in the column “mark on the issuance of a personal file.”

In cases where the departure is formalized during the academic period, the director draws up a statement of current grades for this period.

When students in grades 10 and 11 leave, parents are given a personal file and a certificate of basic general education.

Upon completion of training, students' personal files are transferred to the school archive, where they are stored for 3 years.

Formation and maintenance of personal files of employees of a school or other educational organization is a common practice. At the same time, the current legislation does not establish an obligation for the employer to maintain a personal file for a teacher or other employee of the organization. Keeping a personal file is mandatory for certain categories of employees. These categories of workers are determined by federal legislation, for example:

  • civil servants (clause 5, part 1, article 44 of the federal law of July 27, 2004 No. 79-FZ “On the state civil service of the Russian Federation”);
  • municipal employees (clause 5 of article 28 of the federal law of March 2, 2007 No. 25-FZ “On municipal service in the Russian Federation”).

In educational organizations, personal files of employees are often formed without any legal justification. The structure of personal files is not being built. In the personal file, copies of personal documents, statements and orders, letters of encouragement, and so on are stored in a chaotic manner. Unsystematic and unreasonable storage of documents, including those related to personal data of employees, may serve as a basis for attracting.

When deciding on the need to manage personal affairs, the head of an educational organization assumes responsibility for ensuring the safety of employees’ personal data.

Maintaining personal files of school employees: legal grounds

The legal basis for maintaining the personal file of an employee of an educational organization will be the local regulatory act of the employer. This may be a provision or procedure for maintaining the personal file of an employee of an educational organization. The regulatory act must regulate the procedure for maintaining and the list of documents contained in the personal file.

When adopting a normative act, it is necessary to comply with the requirements of Part 3 of Art. 30 of the Federal Law of December 29, 2012 No. 273-FZ “On Education in the Russian Federation” regarding taking into account the opinion of the representative body of employees of an educational organization.

Taking into account the specifics of the activities of an educational organization, we believe it is advisable to divide the employee’s personal file and the teacher’s portfolio into independent documents.

Approximate structure of an employee’s personal file

In the employee’s personal file, it is advisable to consolidate the following documents:

  • consent to the processing of personal data;
  • a document confirming that the employee is familiar with local regulations;
  • employment contract and additional agreements thereto;
  • a copy of the employment order;
  • a copy of a document confirming the employee’s educational qualifications (if necessary);
  • certificate of presence/absence of criminal record;
  • documents confirming the completion of medical examinations and psychiatric examinations (if necessary);
  • results of certification (current);
  • agreement on liability (if concluded);
  • other documents necessary for the employer to ensure the employee’s labor rights.

Is it possible or not to keep a copy of an employee’s passport or diploma in a personal file?

It is impossible to say categorically “YES” or “NO”. The legislation establishes that the subject of personal data decides to provide his personal data and consents to their processing freely, of his own free will and in his own interest. Based on this, if the employee has consented to the storage and processing of information about himself, the employer has the right to store copies of documents in the employee’s personal file, in particular, a passport, education document.

On the other hand, Art. 86 of the Labor Code of the Russian Federation establishes the goals for the achievement of which an employee’s personal data can be processed:

  • to ensure compliance with laws and other regulations;
  • assistance to employees in finding employment;
  • education and career advancement;
  • ensuring personal safety of workers;
  • control the quantity and quality of work performed;
  • ensuring the safety of property.

Why might an employer need a copy of an employee’s passport? To enter data into the employment contract and the employee’s personal card, approved by Decree of the State Statistics Committee of the Russian Federation dated January 5, 2004 No. 1 “On approval of unified forms of primary accounting documentation for recording labor and its payment” (when mentioned - card form T-2). After entering the necessary information, is there still a need to store a copy of the passport? If so, the employer should stipulate this in local regulations, obtain consent for storage, and then be prepared to explain to inspectors what they are used for.

A copy of the education document can confirm the educational qualification of the employee, giving him the right to carry out teaching activities (Part 1, Article 46 of the Federal Law of December 29, 2012 No. 273-FZ “On Education in the Russian Federation”), so it will be logical in personal case of a teaching worker. And for what purpose do you need to keep a copy of your education document, for example, as a cleaner of office premises, if the work performed does not require special knowledge or special training?

Using the Network City system. Education

Information system “Network City. Education” (when mentioned - the system) allows you to organize the management of personal files of school employees in electronic format. The system generates a personal card of the T-2 form. It is possible to form a teaching portfolio.

Information about the employee is added to the system by sections:

  • Basic information (employee details, position held);
  • Identification documents (information about passport, military ID, etc.);
  • Personal achievements (employee participation in events by year);
  • Contact information (information about the employee’s contacts);
  • Additional information (information about place of residence, employment, certification, etc.).

Thus, maintaining a school employee’s personal file in electronic form includes all the information necessary for the employer and eliminates the need to store copies of documents.

Summarizing

Article 65 of the Labor Code of the Russian Federation contains a wide range of information that an employee must present when applying for a job. However, of the entire list of documents, the employer must keep only the work book (Article 66 of the Labor Code of the Russian Federation). Information about other documents is entered into the T-2 form card.

Labor legislation does not oblige the employer to either make copies of employee documents or store such copies. Many courts find it illegal for an employer to store copies of employee documents, even if the employee has consent to the processing of his personal data. Therefore, the management of personal files of school employees should be organized in such a way that regulatory authorities have a minimum of questions for the employer.

1.1. This Regulation on the procedure for the formation, maintenance and storage of personal files of students of the Municipal educational institution "Secondary school in the village of Beloglinny", Ozinsky district, Saratov region (hereinafter referred to as the Regulations) is drawn up in accordance with the requirements for maintaining documentation in a general educational institution, in order to establishing uniform requirements for the formation, maintenance and storage of personal files of students

1.2. The student’s personal file belongs to educational and pedagogical documentation.

1.3. A student’s personal file is maintained for each student from the moment of enrollment at the educational institution until graduation.

1.6. The provision is mandatory for use by those responsible for the formation, maintenance and storage of personal files of students at educational institutions.

1.7. Information about a student’s personal file is considered personal data and cannot be transferred to third parties except as required by law.

1.8. Responsible persons for the formation, maintenance and storage of personal files of students at educational institutions are appointed by order of the director.

  1. Formation of personal files

2.1. The student’s personal file is drawn up in accordance with these Regulations.

2.2. Responsibility for the formation and maintenance of students’ personal files rests with the class teachers of the classes in which the students are enrolled.

2.3. Form teachers transfer the completed personal files of students to the Deputy Director for Educational Management by September 10 of the current academic year.

  1. List of documents contained in the student’s personal file

3.1. List of documents contained in the personal file upon admission of a student to the level of primary or basic general education:

A copy of the child's birth certificate.

Agreement on the provision of general education by a general education institution.

3.2. List of documents contained in the personal file upon admission of a student to the level of secondary (complete) general education:

Copy of passport (child's birth certificate)

Application from parents (legal representatives) for admission to the educational institution.

Agreement on the provision of general education by a general education institution

A copy of the child’s registration certificate at the place of residence in the assigned territory.

Other documents at the discretion of parents (legal representatives), indicated in the application for admission to the educational institution.

3.2.1. Certificate of basic general education (kept in a safe in the director’s office).

3.3. Parents (legal representatives) of a child who is a foreign citizen or stateless person additionally present duly certified copies of a document confirming the applicant’s relationship (or the legality of the student’s rights) and a document confirming the applicant’s right to stay in the Russian Federation.

3.4. Documents are filed in the student’s personal card.

3.5. When adding copies of documents to your personal file, they are affixed with the certification inscription “Copy is correct”, a signature, the position of the employee, the date of signature, the initials and surname of the employee, and a seal are indicated.

3.6. Foreign citizens and stateless persons submit all documents in Russian or together with a duly certified translation into Russian.

3.7. It is not allowed to store extraneous documents in the student’s personal file.

  1. Maintaining personal files of students during the training period

4.1. The student’s personal file is opened when the student is enrolled in the first grade.

4.2. The student’s personal file must be completed by the class teacher by September 10 of the current academic year.

4.3. The front side of the student’s personal card is filled out by the class teacher.

4.4. General information about students is entered into the student’s personal card by the class teacher. The status of the parents (legal representatives) is indicated - mother, father, guardian, representative by proxy, trustee, as well as the full name, patronymic and surname based on the documents.

4.5. Information about the student as it changes is clarified and entered into a personal card by the class teacher.

4.6. When changing the surname, address, or form of education, the previous information is crossed out with a horizontal line, the new one is written next to it.

4.7. At the end of the school year, the class teacher:

4.7.1. Provides annual grades for academic subjects in the student’s personal card;

4.7.2. Makes a note about the results of the year:

For students who do not have academic debt in all subjects at the end of the academic year, the following entry is made: “Transferred to ________class”;

For students who have academic debt in one or two subjects at the end of the academic year, the following entry is made: “Conditionally transferred to ______ class”;

For students who have completed basic general education, secondary (complete) general education, the entry “Graduated” is entered;

For students who have not eliminated their existing academic debt, the following entry is made: “Retained for repeated studies in ______class.”;

For expelled students, the entry “Excluded” is made.

4.7.3. Enters information about studying elective courses this year;

4.7.4. Makes a record of the student's awards and incentives based on the results of the current academic year

4.8. Based on the results of eliminating academic debt in the student’s personal record:

An unsatisfactory grade given at the end of the academic year in the relevant subject is not corrected;

5.1. When a student transfers to another educational institution, a personal file is issued on the basis of:

Written statement from parents (legal representatives);

5.2. Information about the student’s departure from the educational institution is entered into the personal card.

5.3. When a student leaves the educational institution during the academic year, a statement of current grades in all academic subjects, certified by the seal of the educational institution, is included in the personal file.

5.4. The issuance of personal files is carried out by the Deputy Director for Internal Affairs.

5.5. Issuance of personal files is carried out only to parents (legal representatives) of students.

5.6. When issuing a personal file, an entry is made in the alphabetical book about the student’s departure.

5.7. Personal files of students who graduated from educational institutions or dropped out for other reasons are transferred to the archive.

  1. Acceptance of documents of a student arriving from another educational institution

6.1. When admitting a student who arrived from another educational institution, information about him is clarified and the necessary recording is made in accordance with this provision.

  1. Storing personal files

7.1. Personal files of students during the training period are stored in a designated place.

7.2. Only the person responsible for storing students’ personal files has access to students’ personal files; class teachers are responsible for maintaining personal affairs.

7.3. Deputy directors for academic work and educational work have the right of access to student personal records.

7.4. Personal files of students of the same class are kept together in one folder and arranged in alphabetical order.

7.5. In the class personal files folder there is a list of students indicating the last name, first name, patronymic, date of birth, personal file number, home address and full name. class teacher. The list is updated at the beginning of the school year. During the academic year, changes and additions are made to the list in accordance with the movement of students.

7.6. Control over the status and management of personal files is carried out by the Deputy Director for Academic Affairs, who supervises the movement of students, and the Director of the Educational Institution.

7.7. Upon completion of the educational institution, the students’ personal files are stored in the archive for three years, after which they are destroyed in the prescribed manner.

  1. Monitoring the status of personal affairs

8.1. Monitoring the status of personal files is carried out by the Deputy Director for Internal Affairs and the Director of the Educational Institution.

8.2. Checking the personal files of students and pupils is carried out according to the internal school control plan, at least 2 times a year. If necessary, the inspection is carried out unscheduled and promptly.

  1. The procedure for making changes to the provision and terminating it

9.1. Changes and additions may be made to these Regulations by the pedagogical council due to changes in legislation and the emergence of new regulatory documents on record keeping in a general education institution.

9.2. These Regulations shall cease to apply upon reorganization or liquidation of the OS.
