  4. Health status. Persons who have passed a military medical commission and are classified by it in one of groups “A” (a person is “fit” for military service) and group “B” (a person is fit for military service with minor restrictions) are allowed to serve under a contract.
  5. Fitness level. It must comply with the standards prescribed in the NFP-2009. The physical fitness of a contract soldier is assessed by such qualities as speed, endurance, and strength. In order to assess the listed parameters, a citizen entering contract service must complete one exercise for each of them for verification.
  6. Limitations on professional suitability. During the selection of candidates for contract service, the cases of citizens who have received a conclusion on the assignment of the following categories will be considered:
    - I. This category is assigned to citizens who are “recommended first”;
    - II. This category means that citizens are "recommended";
    - III. Means that the citizen is "conditionally recommended". In the absence of the first two categories.

How to become a contract soldier in the Russian Armed Forces?

Next, he is sent to a military training unit, where he will undergo an intensive combined arms training course. During the training period, the command staff will observe the newly hired contract soldier and study his professional, personal, and physical qualities. His aptitude for leadership (required for sergeant positions) will also be analyzed. After the training course is completed, the contract soldier is sent to the main place where his service in the armed forces will take place.

Contract service - salary of a contract worker in 2018

For the current year, there are two main legislative documents that establish the amount and types of monetary allowance due to contract servicemen in the RF Armed Forces:

  1. Federal Law of November 7, 2011 N 306-FZ “On monetary allowances for military personnel and provision of individual payments to them.”
  2. Decree of the Government of the Russian Federation dated December 5, 2011 N 992 “On the establishment of salaries for military personnel performing military service under a contract.”

The basic salary of contract military personnel, according to the mentioned laws, consists of two parts:

  • Salary for military position;
  • Salary according to military rank.

Various allowances are added monthly to the basic salary of a contract soldier in the Armed Forces of the Russian Federation for:

  1. Qualification.
  2. Longevity.
  3. Risk to health and life.
  4. Special conditions for military service.
  5. Working with classified information that is a state secret.
  6. High level of physical fitness (after passing the standards).
  7. Significant achievements in military service.
  8. Foreign language skills.

Additionally, annual financial assistance (EMA) and bonuses are paid for the fact that the serviceman copes well with his official duties.

The amount of monetary allowance for contract military personnel

Let's focus on specific numbers and voice average salary contract military personnel in 2018 amounted to:

  • 30,000 rubles is the average salary of an ordinary contract soldier.
  • 40,000 rubles is the average salary of sergeants and foremen.
  • 55,000 rubles is the average salary of lieutenants.

  • Compensation for subletting of housing (Resolution of the Government of the Russian Federation dated September 18, 2015 No. 989 “On amendments to the Decree of the Government of the Russian Federation dated December 31, 2004 No. 909”). This payment allows the military to partially reimburse the costs of renting housing if a service apartment was not provided. Cash compensation is paid in accordance with established standards for the region (for example, for the cities of Moscow and St. Petersburg - this is 15,000 rubles as of 2019);
  • “Lifting allowance” - a cash allowance for a military personnel when moving to a new duty station; the lifting allowance is paid not only to the contract soldier, but also to all family members;
  • A one-time benefit upon dismissal from military service is paid upon dismissal with a total length of service of 20 years or more in the amount of 7 salaries (with less than 20 years of service, a contract soldier receives 2 salaries upon dismissal).

Social package for contract military personnel

It is worth noting that the state has provided a wide package of social benefits for contract servicemen:

  1. Free medical care in military medical institutions.
  2. During the period of service, the serviceman is provided with official housing. There are also military mortgage programs, and.
  3. Retirement at 45 years of age (with 20 years of service).
  4. Advantages when entering vocational schools and universities for contract workers.

HEALTH STATE OF A MILITARY SERVICEMAN AND HIS RIGHT TO HOUSING

The constitutional right of a military serviceman to housing, guaranteed by the state, is implemented on the basis primarily of Art. 15 of the Federal Law “On the Status of Military Personnel”.
Guarantees of housing rights, defined by this legislative norm and due to the special status of a military serviceman, include housing construction and the purchase of housing for military personnel - citizens of the Russian Federation at the expense of the federal budget by federal executive authorities that provide for military service.
At the same time, the provision of housing for military personnel - citizens of the Russian Federation, subject to dismissal from military service after January 1, 2005, is carried out at the expense of the federal budget by federal executive authorities, and citizens discharged from military service and registered as needing improved housing conditions before January 1, 2005 in municipalities - at the expense of the federal budget through the issuance of state housing certificates by executive authorities of the constituent entities of the Russian Federation at the place of registration.
It is believed that the special nature and specificity of military service also determine some features of the implementation of housing rights of this category of citizens, in particular, taking into account the state of health of the serviceman on the day of his dismissal from military service.
Dismissal of a serviceman from military service for health reasons, together with some other grounds for dismissal (dismissal from military service upon reaching the age limit and in connection with organizational and staffing measures), determines those “preferential” grounds for dismissal from military service, in the presence of which military personnel and citizens, Those discharged from military service receive certain benefits when exercising their right to housing. Family members of military personnel who died (died) during military service or after discharge also acquire certain rights to housing.
1. Military personnel - citizens of the Russian Federation, upon dismissal from military service for health reasons with a total duration of military service of 10 years or more, are provided with ownership of residential premises at their chosen permanent place of residence (Part 9, Clause 1, Article 15 of the Federal Law “On the Status of Military Personnel” ").
2. 3. For citizens discharged from military service for health reasons, whose total duration of military service is 10 years or more, local government bodies have the right, as a matter of priority, to grant the right to join housing construction (housing) cooperatives or to allocate land plots for the construction of individual residential houses (Clause 12, Article 15 of the Federal Law “On the Status of Military Personnel”).
4. Military personnel - citizens of the Russian Federation, discharged from military service for health reasons, whose total duration of military service is 10 years or more, cannot be excluded without their consent from the waiting list for receiving residential premises (improved living conditions) according to the last one before dismissal place of military service and are provided with living quarters (paragraph 2, paragraph 13, article 15 of the Federal Law “On the Status of Military Personnel”).
5. Providing housing for citizen military personnel with a total duration of military service of 10 years or more, upon dismissal from military service for health reasons, and members of their families upon change of residence, is carried out by the federal executive authorities, which provide for military service, at the expense of the federal budget for the construction and purchase of housing, including through the issuance of state housing certificates (paragraph 1, paragraph 14, article 15 of the Federal Law “On the Status of Military Personnel”).
6. Citizens discharged from military service for health reasons, having a total duration of military service of 10 years or more, upon dismissal from military service have the right to use savings accounted for in the personal savings account of a participant in the savings-mortgage system (subparagraph “b” p. 2, Article 10 of the Federal Law “On the savings and mortgage system of housing for military personnel” of August 20, 2004 N 117-FZ).
7. Family members of military personnel who have lost their breadwinner cannot be evicted from the residential premises they occupy without providing them with another comfortable residential premises free of charge if family members terminate their employment relations with the relevant organizations; after the death of a military personnel, they retain the right to improve their housing conditions in accordance with federal laws and other regulatory legal acts of the Russian Federation.
Repair of individual residential buildings belonging to family members of military personnel who have lost their breadwinner is carried out according to the standards and in the manner established by the Government of the Russian Federation (Clause 2 of Article 24 of the Federal Law “On the Status of Military Personnel”).
8. Family members of citizens who served in military service under a contract and died (died) after dismissal from military service for health reasons, whose total duration of military service is 20 years or more, retain the right to receive living space. In this case, living space is provided to these persons on a priority basis.
These family members of military personnel and citizens discharged from military service have the right to compensation payments for the total area of ​​residential premises occupied by them (in communal premises - living space), as well as the hiring, maintenance and repair of residential premises, and the owners of residential premises and members housing construction (housing) cooperatives - maintenance and repair of public facilities in multi-apartment residential buildings (Clause 4, Article 24 of the Federal Law “On the Status of Military Personnel”).
9. Families of deceased (missing) military personnel who participated in counter-terrorism operations and ensured law and order and public safety in the North Caucasus region of the Russian Federation, who need improved housing conditions, are provided with emergency residential premises in accordance with the standards established by federal laws and other regulatory legal acts of the Russian Federation (clause 10 of the Decree of the Government of the Russian Federation “On additional guarantees and compensation for military personnel and employees of federal executive authorities participating in counter-terrorism operations and ensuring law and order and public safety in the North Caucasus region of the Russian Federation” dated February 9, 2004 city ​​N 65).
Let us recall that the wording of the grounds for dismissal from military service “for health reasons” means that the serviceman is recognized by the military medical commission as unfit or partially fit for military service (subparagraph “c”, “d”, paragraph 1, subparagraph “b” Clause 3 of Article 51 of the Federal Law “On Military Duty and Military Service”).
As can be seen from the above standards, when assessing the state of health of a serviceman in relation to the possibility of his dismissal from military service, only one “parameter” is taken into account - the category of fitness for military service. The question of the causal connection of a disease or health injury for which a serviceman is discharged from the army, specifically with military service, with factors of military labor, is not studied at all and is not taken into account.
A similar situation with failure to establish the causes of health damage also occurs when determining the housing rights of family members of deceased (deceased) military personnel and citizens discharged from military service for health reasons.
Such “ignoring” of the causes of health damage does not correspond to the social orientation of the benefits established by the state in the field of housing provision for a certain category of military personnel who received health damage due to the direct influence of military service factors.
Cases cannot be ruled out when a disease that a soldier has arises and develops regardless of the special conditions of military service. This also applies to other health injuries, especially those that are diagnosed in citizens after discharge from military service.
According to Art. 41 of the Regulations on military medical examination, approved by Decree of the Government of the Russian Federation of February 25, 2003 N 123, a conclusion on the causal relationship of injuries and diseases of military personnel, citizens who served in military service, can be made, including in the wording “the disease was acquired in period of military service" (not related to the performance of military service duties), "general illness" (not related to military service at all).
As stated above, family members of citizens who served in military service under a contract and died (died) after dismissal from military service for health reasons, whose total duration of military service is 20 years or more, retain the right to receive living space on a priority basis. But after leaving military service, a citizen may die for reasons unrelated to an existing disease acquired during military service (for example, death in an accident). Nevertheless, for family members of such a citizen, the same benefits in the field of housing are retained as for family members of a serviceman who died while performing a combat mission in counter-terrorism operations in the North Caucasus region of Russia.
Incorrect versions of the legislative norms under consideration only allow us to assume the existence of a causal connection between the health damage received by a serviceman, including that leading to death, and the factors of military service. But the assumption does not apply to the norms of substantive law.
It seems that when establishing housing benefits for military personnel, citizens discharged from military service, and members of their families, it is necessary to take into account not only the category of their suitability for military service, but also the causal connection of the existing health damage with military service.
