Living wage in Perm and the Perm region

The latest news suggests that on February 7, the Government of the Perm Territory adopted Resolution No. 65-p “On establishing the cost of living for the fourth quarter of 2018.” It contains the following PM indicators for the 4th quarter:

  • Per capita - 10,098 rubles.
  • For able-bodied persons - 10,804 rubles.
  • For pensioners - 8,279 rubles.
  • For children - 10,289 rub.

Earlier, on October 23, 2018, the Government of the Perm Territory, by Resolution No. 622-p, established the cost of living for the 3rd quarter of 2018. If we compare these data with those previously specified in Resolution No. 422-p dated July 25, 2018 (for the 2nd quarter of 2018), we see that they remained unchanged. The same figures are given in resolutions No. 230-p of 04/27/2018, No. 51-p of 02/07/2018, No. 888-p of 11/01/2017, No. 756-p of 08/29/2017. Since the 2nd quarter of 2017, the PM in the Perm region has not changed.

The cost of living for the 1st quarter of 2019 in the Perm Territory will be established approximately in May-June 2019.

Normative base

What is the regional Government guided by when adopting new regulations:

  • provisions No. 134-FZ “On the subsistence level in the Russian Federation” dated October 24, 1997;
  • LAW No. 1832-389 “On state social assistance in the Perm region” dated November 30, 2004;
  • Law No. 224-PK “On the consumer basket for the main socio-demographic groups of the population as a whole in the Perm Territory” dated August 28, 2013.

Government regulations establishing the PM instruct state authorities and local self-government bodies to use this value as an instrument of social policy and implement social protection measures for the local population with its help.

There is an exception, it was introduced by regional law No. 299-PK dated November 1, 2018. It separately sets the cost of living for pensioners for the entire 2019. This indicator is not always used, but only when calculating the social supplement to the pension. According to the text of this law, the minimum wage for pensioners, on the basis of which the additional payment is established, is equal to 8,539 rubles. Previously, Law No. 150-PK dated October 31, 2017, which was in force in 2018, established the pension minimum at 8,503 rubles. That is, the figure increased by 36 rubles.

Regional and federal cost of living

The federal minimum wage in the Perm Territory from January 1, 2019, as well as throughout Russia, was increased to 11,280 rubles. At the federal level, it is established using data on the cost of living for the 2nd quarter of the past year. The minimum is calculated based on data provided by Rosstat.

The value of the regional minimum wage cannot be lower than the federal one. If a difference arises, the state standard applies. The minimum in the Perm Territory is determined on the basis of information from the Territorial Body of the State Statistics Service.

However, in Perm there is another document regulating the minimum wage. It was signed by representatives of the Government of the region, the regional association of trade unions “Perm Kraisovprof” and the Union of Industrialists and Entrepreneurs of the region “Cooperation”. They developed and approved Agreement No. SED-01-37-89 on the minimum wage in Perm for 2017-2019. dated November 11, 2016. In the Agreement on the Minimum Wage, the regional authorities approved the rule that the basis for the local “minimum wage” will be considered the subsistence minimum for workers not for the second, but for the fourth quarter of the previous year.

Therefore, in Perm, the cost of living, which affects the minimum wage in 2019, is taken as data for the 4th quarter of 2018: the minimum wage for the working population is 10,804 rubles. Since the figure is lower than the established federal minimum wage, the regional norm does not apply. If this value is higher than the federal one, then the local “minimum wages” must be recalculated.

Minimum salary in the Perm region in 2019 - regional coefficients

The federal minimum wage is now 11,280 rubles. In the Perm Territory, the same indicator is used as throughout the Russian Federation. In fact, the employee can receive money in his hands in a smaller amount than the specified amount, since 13% of personal income tax is withheld from the salary.

A special feature of the Perm region is that regional correction coefficients apply here:

  • 1.20 - in Krasnovishersky, Cherdynsky, Nyrobsky, Kosinsky, Gainsky, Kochevsky districts, Solikamsk, other areas of the Far North or equivalent to them.
  • 1.15 - in Ilyinsky and all other districts, except those that are entitled to the “northern” bonus.

The minimum wage threshold should be calculated without taking into account allowances. The current minimum wage is multiplied by these special Ural coefficients before tax is deducted from it. In both budgetary organizations and commercial organizations, it is prohibited to pay wages below the minimum wage. This threatens employers with fines. At the same time, not only the employee’s salary, but also bonuses are included in remuneration.


Average salary in the Perm region in 2019 according to Rosstat

Official statistics data are available on the Permstat website. In December, the department published data on average accrued salaries in January-October 2018, so it is premature to talk about statistics for 2019.

As of October 2018, the average regional salary is 34,438.6 rubles. It decreased significantly compared to June 2018, when the amount of 37,066.7 rubles was announced. At the same time, compared to January-October 2017, it increased by 8.3%.

It is most profitable to work in the mining sector, where the average salary in October 2018 reached 52,330 rubles. (in summer this figure was 56,519.2 rubles). Work related to:

  • hunting and fishing - 20,789.3 rubles;
  • activities of catering and hotels - 19,830.8 rubles;
  • provision of services - 23,182.1 rubles;
  • operations with real estate - 23,803.4 rubles.

Statistics show how real wages are higher than the minimum acceptable level established by the state.

Since January 1, 2019, the minimum wage in the Perm region, as well as throughout Russia, is 100% of the subsistence level. This change must be taken into account when calculating employee salaries and benefits. Paying less than the minimum wage is dangerous.

Minimum wage in the Perm region: changes from January 1, 2019

In the Perm Territory, the level of the minimum wage is regulated by the Agreement on the minimum wage in the region for 2017-2019 dated November 11, 2016 No. SED-01-37-89. The document is valid from January 1, 2017 to December 31, 2019 inclusive.

From May 1, 2018, the minimum wage in the Perm Territory, in connection with the increase in the federal minimum wage to 100% of the subsistence level in accordance with Federal Law dated 03/07/18 No. 41-FZ, should be guided by federal values. Commercial organizations are also required to switch to the new minimum wage. Indeed, according to the law on minimum wages (dated June 19, 2000 No. 82-FZ), the minimum wage in the region cannot be lower than the subsistence level of the working population for the 2nd quarter of the previous year in Russia as a whole.

The Ministry of Labor has already approved the living wage for the 2nd quarter of 2018. - 11,280 rubles.

According to the document, the cost of living for the 2nd quarter of 2018 is:

  • on average per capita - 10,444 rubles.
  • for the working population - 11,280 rubles.
  • for pensioners - 8,583 rubles.
  • for children – 10,390 rub.

Thus, the minimum wage in the Perm region since 2019 is 11,280 rubles.

The Resolution of the Constitutional Court of the Russian Federation dated December 7, 2017 No. 38-P states that increased wages in connection with work in special climatic conditions should be made after determining the amount of wages. The regional coefficient and percentage bonus accrued in connection with work in areas with special climatic conditions, including in the Far North and equivalent areas, cannot be included in the minimum wage. In the Perm Territory, since January 1, 2019, a regional premium of 1.15 and 1.2 has been in effect.

Minimum wage in 2019 in the Perm region, taking into account the Ural coefficient

The Perm region is a territory with special climatic conditions. The region was formed in 2004 as a result of the merger of the Perm region and the Komi-Permyak Autonomous Okrug. Therefore, it is necessary to take into account the norms of regional coefficients established for the Perm region and the Komi-Permyak Autonomous Okrug before their unification.

The following regional coefficients apply for the Perm region:

  • 1.15 - the rest of the Perm region.

The minimum wage by region is a value that can vary significantly depending on what rules are used to determine it. Let's consider how the regional minimum wage is established, what is its relationship with a similar federal indicator and what specific values ​​it takes in the regions.

Rules for establishing minimum wages in the regions

In addition to the minimum wage for labor determined at the all-Russian level, it is also possible to adopt a regional value for this value (Article 133.1 of the Labor Code of the Russian Federation). By region, the minimum wage can be introduced for all categories of workers, with the exception of those who work in organizations financed from the Federation budget. For the latter, the minimum wage is always equal to it.

A regional minimum will only apply within the region that established it. For its value, differentiation is acceptable depending on sources of funding, scale, specific area and types of activities of employers. But at the same time, it cannot be less than the value established for the federal minimum.

For regions, the minimum wage is decided by a 3-party commission consisting of representatives of the government of the constituent entity of the Russian Federation, workers (trade unions) and employers. This decision becomes binding for all employers in the region if they do not submit a written refusal to implement this decision to the leadership of the constituent entity of the Russian Federation within 30 days from the date of its publication. For employers who refuse to apply the minimum wage introduced in the region, the federal value of this indicator will apply.

The Labor Code of the Russian Federation (Articles 133 and 133.1) when determining the minimum wage for labor obliges to focus on the level. However, for the minimum wage introduced at the all-Russian level, this requirement was not met until May 1, 2018. Meanwhile, many regions, when determining their own minimum wages for labor, proceeded precisely from the value of the subsistence minimum. Therefore, the regional minimum wage in the constituent entities of the Russian Federation that applied the regional coefficient or salary supplements turned out to be established already taking into account these additional payments. However, the Constitutional Court (resolution No. 38-P dated December 7, 2017) indicated that this is incorrect: all of the above additional payments should not be included in the minimum wage, but are added to it additionally.

Consequences of updating the federal minimum wage 2018 (including from May 1) for the regions

Of particular importance for the regional minimum wage is the condition that it cannot be less than the federal value of a similar indicator. This is due to the fact that an increase in the latter may lead to the fact that the value established by the region cannot actually be applied.

The federal minimum wage was increased twice in 2018: from 01/01/2018 (to 9,489 rubles) and from 05/01/2018 (to 11,163 rubles). On the first of these dates, it again turned out to be below the subsistence level, despite the fact that linking these 2 values ​​had already been established by law (Law “On Amendments...” dated December 28, 2017 No. 421-FZ). The relationship between the minimum wage and the subsistence level, which has already become traditional at the federal level, led to the fact that in regions that, when setting their minimum wage, are guided by the minimum standard of living, changes in the amount of the minimum wage were required only for those situations where the federal minimum wage was applied: for employers who have not joined the regional agreement;

  • persons financed from the federal budget;
  • cases where the minimum by regional law was established equal to the federal one;
  • calculations requiring the application of the minimum wage established for the country as a whole.

That is, the basic rules provided for by regional agreements continued to apply at the beginning of 2018.

On the second date, the value of the minimum wage turned out to have increased so much that in many regions it exceeded the value that, according to the regional agreement, should have been applied in the constituent entity of the Russian Federation. That is, the increase in the all-Russian minimum wage from May 1, 2018 by region has led to the fact that in many of them the regional minimum has become equal to the federal one. At the same time, some of the regional agreements have lost their applicability, and not all of them have been replaced by updated versions of such a document.

Thus, from May 1, the minimum wage in the regions becomes either corresponding to the federal one or very close to it in value, which leads to the equalization of this indicator for the Russian Federation as a whole. The difference in its actual value is determined by the surcharges applied in the region ().

The amounts given in it for 2 dates (01/01/2018 and 05/01/2018) clearly reflect the process of convergence of the 2018 minimum wage values ​​by region, despite the fact that approximately 1/3 of them did not accept the regional document on such a minimum at all, and in those agreements concluded between the subjects set out different rules for its establishment.

For example, the minimum wage in the Volgograd region in 2018, from January 1, was 11,228 rubles. for organizations that receive funding not from the budget, based on the fact that it is set equal to 1.2 times the cost of living (regional agreement on minimum wages dated July 5, 2016 No. C-272/15). The same value is valid as of 05/01/2018. At the same time, the minimum wage for persons with budgetary financing as of 01/01/2018 was 9,489 rubles, and on 05/01/2018 it increased to 11,163 rubles. That is, in the Volgograd region, from January 1, 2018, the minimum wage for commercial structures was noticeably higher than for public sector employees, and as of May 1, 2018, they were almost equal. A similar situation occurs with respect to the minimum wage 2018 in the Rostov region. Only there the minimum wage for persons not financed from the budget is 11,828.4 rubles.

In the Belgorod region, the minimum wage from January 1, 2018 corresponds to the federal value of this indicator, since its value according to the regional agreement for 2017-2019 (adopted on December 20, 2016) must correspond to the subsistence minimum, and the amount of the latter for both key dates for the minimum wage in 2018 (1 January and May 1) was below the federal minimum wage.

In the Perm Territory, the minimum wage in 2018, from January 1, had 2 values: 10,804 rubles. (at the cost of living) for organizations not financed from the budget, and 9,489 rubles. for persons with budget funding (regional agreement dated November 11, 2016 No. SED-01-37-89). As of May 1, 2018, there is no difference between the minimum wages for the above persons, since the federal minimum wage exceeded the subsistence level in the region. A similar situation arose with the minimum wage in the Nizhny Novgorod region: from January 1, 2018, there were also 2 values ​​of this minimum (10,000 rubles and 9,489 rubles), instead of which, from 01.05.2018, only one value was applied (11,163 rubles. ), corresponding to the all-Russian one.

In the Samara region. The minimum wage from January 1, 2018, as well as from May 1, 2018, is equal to its federal value, since a regional agreement was not adopted in this region.

The minimum wage in Moscow from January 1, 2018 and from May 1, 2018 has the same value that has been in effect since the 4th quarter of 2017 (RUB 18,742), since its amount, although revised quarterly in relation to the subsistence level ( regional agreement of December 15, 2015), but cannot be reduced, even if the cost of living has decreased.

The 2018 minimum wage in Sevastopol is subject to 2 regional documents:

  • agreement dated December 28, 2017 No. 5-17, according to which the minimum wage as of January 1 is 9,500 rubles. for commercial structures and 9,489 rubles. for state employees;
  • agreement dated 04/04/2018 No. 1-18, which increased the minimum wage for persons not financed from the budget to 11,200 rubles from 05/01/2018. and thereby almost equalizing it with the minimum effective from the same date for public sector employees.

With regard to the minimum wage 2018 in the Stavropol Territory, there is a decree on this indicator, concluded in 2016, according to which its value is tied to the subsistence level. However, for both key dates for the minimum wage in 2018, the regional cost of living is lower than the federal minimum wage.

The minimum wage in the Khabarovsk Territory from January 1, 2018 was set equal to its federal value, since the amounts (they were differentiated by regions of the region) provided for by the regional agreement of December 29, 2017, adopted for 2018, turned out to be lower than the all-Russian minimum applied with regional coefficients and allowances. The next change to the all-Russian minimum wage 2018 finally nullified the possibility of applying the regional agreement on the minimum wage, and it was terminated on May 1, 2018.

Results

Regions of the Russian Federation have the right to introduce their own minimum wages for labor, but not lower than the all-Russian one. Regional coefficients and premiums should be applied to its value. The increase in the federal minimum wage, carried out twice during 2018, led to the fact that in many regions that had determined the procedure for introducing their minimum, regional rules actually ceased to apply and the minimum wage in them became equal to the all-Russian one as of May 1, 2018.

What is the minimum wage

The minimum wage, or minimum wage, was first adopted by the United Nations in 1970. In the USSR, the minimum wage limit was adopted in 1973; its volume was 70 rubles and did not change until 1991. Over the past 17 years, the value of the minimum remuneration for work in Russia has increased more than 111 times.

Minimum wage– a lower threshold approved at the legislative level of the Russian Federation, which is used to control wages, establish the amount of payments for temporary unemployment of an employee, the amount of tax deductions, contributions to extra-budgetary funds, the amount of maternity benefits, and the amount of child care benefits.

In addition, the minimum wage has a significant impact on the country’s economy:

  • An increase in the minimum wage increases revenue to the country's budget

  • Causes unemployment during a crisis, since job cuts are the only solution if it is impossible to reduce wages below a certain level.

The minimum wage from January 1, 2017 is 7,500 rubles

As a rule, changes to the minimum limit occur on the first day of the new year. However, this did not happen in 2017; at the moment, the minimum line corresponds to 7,500 rubles, it was established on July 1, 2016.

At the same time, the 2017 minimum wage, adopted in July 2016, began to be displayed on the amount of insurance premiums only from January 1 of the current year. This happened due to the fact that the recalculation of the amount of insurance premiums, according to Russian legislation, can occur once a year.

From July 1, 2017, the minimum wage in Russia will increase to 7,800 rubles

This year, the minimum salary limit for employees will change on July 1 and the new minimum wage will be 7,800 rubles.

In addition to inflation, the following factors influence the lower wage limit:

  • Unemployment rate in the country
  • Efficiency of activities of entrepreneurs and organizations
  • State pricing policy

It should be noted that the change in the minimum wage that will occur on July 1, 2017 will not affect the amount of insurance premiums, since their recalculation already took place on the first day of this year.

It is noteworthy that the minimum wage includes not only the employee’s salary itself, but also all kinds of allowances: compensation, bonuses, rewards.

At the same time, the salary required by law is paid for a certain period, and not for the actual amount of time worked. That is, an employee can work two shifts, but his monthly minimum wage will be 7,500 rubles.

As for the forecast, experts talk about a further increase in the minimum wage. Thus, in 2018, according to experts, the lower limit of wages should reach 8 thousand rubles.

We all understand that wages in Moscow or St. Petersburg cannot be compared with wages in Pskov or Tolyatti. It was this fact that contributed to the emergence of the concept of regional minimum wage.

In this case, the regional minimum wage must be higher than or equal to the federal one. So the minimum wage in Moscow in 2017 is 2.3 times higher than the federal one.

The process of establishing a regional lower limit is interesting: it is determined by local authorities after agreement with trade unions and employers. Moreover, if a businessman does not agree with the decision of local authorities, he can conduct his activities according to the federal border. To do this, he must send a letter to the Labor Inspectorate.

Also, regional figures do not apply to employees employed in companies whose activities are funded from the federal budget.

Regional significance does not affect the amount of benefits and payments.

Minimum wage, insurance payments and benefits

Let's calculate payments for pension and health insurance.

The formula for calculating the amount of payments for employee pension insurance is as follows:

Minimum wage * 12 months * 26%. Let's substitute 7,500 into the formula and get 23,400 rubles.

The formula for calculating the amount of payments for health insurance is presented as follows:

Minimum wage * 12 months * 5.1%. Thus, the deduction for the employee’s health insurance will be 4,590 rubles.

Now let's look at the timing of insurance payments. When and how to make mandatory payments, each entrepreneur decides for himself. He can make contributions on any day during the year, he can pay the entire amount at once, or he can pay it in parts.

The deadline for paying insurance premiums is the last working day of each year. Moreover, if December 31st falls on a weekend, the last day of payments is postponed to the first working day of the next year.

In addition, those businessmen who receive an annual income above 300 thousand rubles are required to pay an additional 1% for pension insurance on income exceeding 300 thousand rubles.

There is also a limit on the maximum amount of pension insurance payments per employee. They should not exceed eight times the minimum wage.

That is, the maximum amount of payments to the pension fund in 2017 will be 60 thousand rubles. And the total amount of payments towards pension insurance for the year cannot exceed 187,200 rubles.

As for benefit payments, the minimum wage affects their volume in the following cases:

  • The employee's length of service does not exceed six months
  • The employee's salary is less than the minimum wage

Maternity and pregnancy benefits are calculated using the following formula:

(Number of days of maternity leave * minimum wage * 24 months) / 730 days (two years) and amounts to 34,521.2 rubles for 2017.

Can the salary be lower than the minimum wage?

Is it possible to set an employee’s salary below the minimum wage? Oddly enough, the answer to this question is yes.

This is possible in the following cases:

  • An employee works part-time for your company. In these cases, the salary depends on the number of hours worked and, accordingly, may be lower than the established minimum. It is necessary to make a reservation that such a state of affairs is possible only with mutual consent and the conclusion of an additional agreement
  • The employee works part-time for the organization. They are initially hired on no more than part-time basis, so can only receive 50% or less of the minimum wage
  • An employee's salary consists not only of a fixed salary, but also of a monthly bonus and allowances. The employee did not fulfill the monthly quota and was not entitled to a bonus according to the local act on the calculation of bonuses. In this case, the employee will not receive a bonus and his monthly payment will be below the minimum wage. But here it is important to prescribe the procedure for paying bonuses (indicators, volume)

Responsibility for wages below the minimum wage

If none of the above conditions are met, but your employees are paid below the minimum, you will face certain sanctions.

These sanctions take the form of fines. The amount of fines depends on the severity of the violator, that is, the number of violations, as well as on the size of the organization and its legal status.

If you are the head of a department, production, small organization, or are a private entrepreneur, then for violating the law you will be fined from one to five thousand rubles. If you did not learn the lesson the first time and repeated the violation, the fine will vary from ten to twenty thousand rubles.

If you are a legal entity, the head of a large company, then for underpayment to employees you will be fined in the amount of thirty to fifty thousand rubles. If this is not the first time you have been caught, the fine will increase and will range from fifty to seventy thousand rubles.

At the same time, remember that the minimum wage in Russia includes not only a fixed salary, but also bonuses, allowances and raises. Therefore, the salary itself may be lower than the minimum minimum wage (this is not punishable by law), if the employee’s total salary per month, taking into account all additional payments, reaches up to the minimum wage.
