In accordance with the Federal Law On Licensing of Certain Types of Activities, the Government of the Russian Federation decides:

1. Approve the attached Regulations on licensing activities for installation, maintenance and repair of fire safety equipment for buildings and structures.

2. To recognize as invalid:

paragraph 1 of the Decree of the Government of the Russian Federation of October 25, 2006 N 625 On licensing activities in the field of fire safety (Collection of Legislation of the Russian Federation, 2006, N 44, Art. 4599) regarding approval of the Regulations on licensing of installation, repair and maintenance work means of ensuring fire safety of buildings and structures;

subparagraph b of paragraph 22 of the changes that are made to the acts of the Government of the Russian Federation on issues of state control (supervision), approved by Decree of the Government of the Russian Federation dated April 21, 2010 N 268 On amendments and invalidation of certain acts of the Government of the Russian Federation on issues of state control (supervision) (Collected Legislation of the Russian Federation, 2010, No. 19, Art. 2316);

subparagraph b of paragraph 23 of the changes that are made to the resolutions of the Government of the Russian Federation on issues of state duty, approved by Decree of the Government of the Russian Federation dated September 24, 2010 N 749 On amendments to certain resolutions of the Government of the Russian Federation on issues of state duty (Collection of Legislation of the Russian Federation, 2010, N 40, art. 5076).

Regulations on licensing activities for installation, maintenance and repair of fire safety equipment for buildings and structures

1. These Regulations determine the procedure for licensing the installation, maintenance and repair of fire safety equipment for buildings and structures carried out by legal entities and individual entrepreneurs.

2. Licensing of activities for the installation, maintenance and repair of fire safety equipment for buildings and structures (hereinafter referred to as the licensed activity) is carried out by the Ministry of the Russian Federation for Civil Defense, Emergency Situations and Disaster Relief (hereinafter referred to as the licensing authority).

3. Licensed activities include the performance of work and the provision of services in accordance with the application (hereinafter referred to as work, services).

4. Licensing requirements for carrying out licensed activities are:

a) the license applicant (licensee) has equipment, tools, technical documentation, technical means, including measuring instruments, belonging to him by right of ownership or other legal basis, meeting the established requirements and necessary for the performance of work and provision of services;

b) the presence on the staff of the license applicant (licensee) of workers who have concluded employment contracts with him, who have vocational education (vocational training) corresponding to the performance of work and provision of services, as well as minimum work experience (at least 50 percent of employees) in the field licensed activity, amounting to 3 years - for a legal entity;

c) the license applicant (licensee) has a professional education (vocational training) corresponding to the performance of work and provision of services, as well as a minimum work experience in the field of licensed activity of 3 years - for an individual entrepreneur;

d) advanced training of persons specified in subparagraphs b and c of this paragraph in the field of licensed activities at least once every 5 years;

e) fulfillment by the licensee of the requirements for the design, installation, maintenance and repair of fire safety equipment for buildings and structures established by regulatory legal acts and regulatory and technical documents in accordance with Article 20 of the Federal Law on Fire Safety;

f) the use by the licensee, when carrying out licensed activities, of products that have a declaration of conformity or a certificate of conformity, which are provided for in Part 4 of Article 145 of the Federal Law Technical Regulations on Fire Safety Requirements.

5. To obtain a license, the license applicant sends or submits to the licensing authority an application and documents specified in Part 1 and paragraphs 1, 3 and 4 of Part 3 of Article 13 of the Federal Law on Licensing of Certain Types of Activities, as well as:

a) copies of documents confirming the qualifications of workers carrying out licensed activities - for a legal entity;

b) copies of documents confirming the qualifications of the license applicant carrying out licensed activities - for an individual entrepreneur;

c) copies of documents or duly certified extracts from documents confirming the length of service of employees carrying out licensed activities - for a legal entity;

d) copies of documents confirming that the license applicant has equipment, tools, technical documentation, technical means, including measuring instruments, belonging to him by right of ownership or other legal basis, meeting established requirements and necessary to perform work and provide services.

6. Submission by the license applicant of an application and documents necessary to obtain a license, their acceptance by the licensing body, the licensing body making a decision on granting a license (refusing to grant a license), re-issuing, suspending, renewing its validity, issuing a duplicate, copies of licenses, as well as maintenance of the information resource and register of licenses, provision of information contained in the information resource and register of licenses is carried out in the manner established by the Federal Law on Licensing of Certain Types of Activities.

7. Gross violations of licensing requirements include violations of the requirements provided for in subparagraphs a and e of paragraph 4 of these Regulations, entailing the consequences established by Part 11 of Article 19 of the Federal Law on Licensing of Certain Types of Activities.

8. When checking the information contained in the documents submitted by the license applicant (licensee), the licensing authority requests the information necessary for the provision of state services in the field of licensing, which is at the disposal of bodies providing state and municipal services, other state bodies, local government bodies or subordinate them organizations, in the manner established by the Federal Law on the Organization of the Provision of State and Municipal Services.

9. Information containing information provided for in parts 1 and 2 of Article 21 of the Federal Law On Licensing of Certain Types of Activities is posted by the licensing authority in the official electronic or printed media of the licensing authority, as well as on information stands on the premises of the licensing authority within 10 days from days:

b) the licensing authority makes a decision on granting and re-issuing a license, suspending and renewing a license;

c) receiving information from the Federal Tax Service on the liquidation of a legal entity or termination of its activities as a result of reorganization, on the termination by an individual of activities as an individual entrepreneur;

d) the entry into force of a court decision to revoke the license.

10. If the licensee intends to carry out a licensed activity at the address of the place where work is performed and services are provided and (or) to perform new work and provide new services that constitute the licensed activity, not specified in the license, this address and (or) work are indicated in the application for re-issuance of the license and the services that the licensee intends to perform and provide, as well as:

a) information about the licensee’s availability of equipment, tools, technical documentation, technical means, including measuring instruments, belonging to him by right of ownership or other legal basis, meeting the established requirements and necessary for the performance of work and provision of services;

b) information about the licensee’s availability of employees with professional education (vocational training) corresponding to the performance of work and provision of services - for a legal entity;

c) information about the licensee’s professional education (vocational training) corresponding to the performance of work and provision of services - for an individual entrepreneur;

d) information on advanced training of the licensee’s employees in the field of licensed activities - for a legal entity.

11. Licensing control is carried out in the manner prescribed by the Federal Law on the Protection of the Rights of Legal Entities and Individual Entrepreneurs in the Exercise of State Control (Supervision) and Municipal Control, taking into account the specifics of organizing and conducting inspections established by the Federal Law on Licensing of Certain Types of Activities.

12. For the granting of a license by the licensing authority, re-issuance of a license and issuance of a duplicate license on paper, a state fee is paid in the amounts and in the manner established by the legislation of the Russian Federation on taxes and fees.

List of works and services that constitute the installation, maintenance and repair of fire safety equipment for buildings and structures

1. Installation, maintenance and repair of fire extinguishing systems and their elements, including dispatching and commissioning.

2. Installation, maintenance and repair of fire and security fire alarm systems and their elements, including dispatch and commissioning.

3. Installation, maintenance and repair of fire water supply systems and their elements, including dispatching and commissioning.

4. Installation, maintenance and repair of smoke removal and smoke ventilation systems (elements of systems), including dispatch and commissioning.

5. Installation, maintenance and repair of fire warning and evacuation systems and their elements, including dispatch and commissioning.

6. Installation, maintenance and repair of photoluminescent evacuation systems and their elements.

7. Installation, maintenance and repair of fire curtains and veils, including dispatching and commissioning.

8. Installation, maintenance and repair of filling openings in fire barriers.

9. Construction (laying, installation), repair, cladding, thermal insulation and cleaning of stoves, fireplaces, other heat-generating installations and chimneys.

10. Carrying out work on fire protection of materials, products and structures.

11. Installation, maintenance and repair of primary fire extinguishing equipment.

On licensing of installation, maintenance and repair of fire safety equipment for buildings and structures

In accordance with “On licensing of certain types of activities”, the Government of the Russian Federation decides:

1. Approve the attached Regulations on licensing activities for installation, maintenance and repair of fire safety equipment for buildings and structures.

2. To recognize as invalid:

Clause 1 of the Decree of the Government of the Russian Federation of October 25, 2006 N 625 “On licensing activities in the field of fire safety” (Collected Legislation of the Russian Federation, 2006, N 44, Art. 4599) regarding the approval of the Regulations on licensing installation and repair work and maintenance of fire safety equipment for buildings and structures;

Subparagraph "b" of paragraph 22 of the changes that are made to the acts of the Government of the Russian Federation on issues of state control (supervision), approved by Decree of the Government of the Russian Federation dated April 21, 2010 N 268 "On introducing amendments and invalidating certain acts of the Government of the Russian Federation on issues of state control (supervision)" (Collected Legislation of the Russian Federation, 2010, No. 19, Art. 2316);

3. Licensed activities include the performance of work and the provision of services in accordance with the application (hereinafter referred to as work, services).

4. Licensing requirements for carrying out licensed activities are:

b) the presence on the staff of the license applicant (licensee) of workers who have entered into employment contracts with him, have professional technical education (vocational training) and have undergone advanced training appropriate to the performance of work and provision of services, as well as a minimum work experience (not less than 50 percent of employees) in the area of licensed activities, amounting to 3 years - for a legal entity;

c) the license applicant (licensee) has documents confirming receipt of professional technical education (vocational training) corresponding to the performance of work and provision of services, and completion of advanced training, as well as a minimum work experience in the field of licensed activity of 3 years - for an individual entrepreneur;

d) advanced training of persons specified in subparagraphs “b” and “c” of this paragraph in the field of licensed activities at least once every 5 years;

5. To obtain a license, the license applicant sends or submits to the licensing authority an application and documents specified in “On licensing of certain types of activities,” as well as:

a) copies of documents confirming the qualifications of workers carrying out licensed activities - for a legal entity;

b) copies of documents confirming the qualifications of the license applicant carrying out licensed activities - for an individual entrepreneur;

c) copies of documents or duly certified extracts from documents confirming the length of service of employees carrying out licensed activities - for a legal entity;

6. Submission by the license applicant of an application and documents necessary to obtain a license, their acceptance by the licensing body, the licensing body making a decision on granting a license (refusing to grant a license), re-issuing, suspending, renewing its validity, issuing a duplicate, copies of licenses, as well as maintenance of the information resource and register of licenses, provision of information contained in the information resource and register of licenses are carried out in the manner established “On licensing of certain types of activities”.

8. When checking the information contained in the documents submitted by the license applicant (licensee), the licensing authority requests the information necessary for the provision of state services in the field of licensing, which is at the disposal of bodies providing state and municipal services, other state bodies, local government bodies or subordinate them organizations, in the manner established by the Federal Law "On the organization of the provision of state and municipal services."

9. Information containing information provided for “On licensing of certain types of activities” is posted by the licensing authority in the official electronic or printed media of the licensing authority, as well as on information stands on the premises of the licensing authority within 10 days from the date:

b) the licensing authority makes a decision on granting and re-issuing a license, suspending and renewing a license;

d) the entry into force of a court decision to revoke the license.

10. If the licensee intends to carry out licensed activities at the address of the place of implementation of the licensed type of activity, not specified in the license, and (or) perform new work and provide new services that constitute the licensed activity, not specified in the license, this address shall be indicated in the application for re-issuance of the license and (or) work and services that the licensee intends to perform and provide, as well as:

c) information about the licensee’s professional technical education (vocational training) corresponding to the performance of work and provision of services - for an individual entrepreneur;

d) information on advanced training of the licensee’s employees in the field of licensed activities - for a legal entity.

11. Licensing control is carried out in the manner prescribed by the Federal Law “On the Protection of the Rights of Legal Entities and Individual Entrepreneurs in the Exercise of State Control (Supervision) and Municipal Control”, taking into account the specifics of organizing and conducting inspections established “On Licensing of Certain Types of Activities”.
