On February 22, 2017, Order of the Ministry of Economic Development of Russia dated September 7, 2016 N 570 “On amendments to the Order of the Ministry of Economic Development of Russia dated May 30, 2014 No. 326 “On approval of the Accreditation Criteria, the list of documents confirming the compliance of the applicant, accredited person with the criteria” was published accreditation, and a list of documents in the field of standardization, compliance with the requirements of which by applicants and accredited persons ensures their compliance with the accreditation criteria.”

This document contains a number of significant changes aimed, first of all, at implementing the previously outlined plans of Rosakcreditation to increase the efficiency of its functions in the field of regulating relationships between participants in the accreditation system.

The changes, in particular, affected the relationship between accredited persons in terms of planning and determining the conditions for participation in interlaboratory comparison tests (ICT). In accordance with the policy of RosAccreditation on participation in proficiency testing activities by conducting interlaboratory comparative tests, the laboratory must take part in MSI programs at least once a year. An accredited laboratory, within 5 years from the date of the decision on accreditation, must take part in the ICT for all test methods included in the scope of accreditation.

The organizational and legal form of ownership of premises and equipment in the organization has been clarified. Now, instead of the phrase “possession and (or) use”, it is necessary to indicate information about the premises and equipment under the right of “possession and use”. The corresponding changes also affected the forms of the attached samples about information characterizing compliance with the requirements of the accreditation criteria (Appendix 1, Appendix 2: Samples 1, 2, 3, 4 and 6, Appendix 3: Samples 1, 2, 3 and 4, Appendix 4: Arr. 1, 2 and 4, Appendix 5: Arr. 1, 2, 3, 4 and 6)

Accredited persons will also need to provide for the storage on paper and (or) in the form of electronic documents signed with an enhanced digital signature, archives of documents, including incoming applications from customers during the validity period of the issued documents and a year after (for certification bodies), and for IL about the results of research (tests) within 3 years from the date of issue of such a document or a decision to refuse to issue it.

A number of changes affected individual certification bodies in terms of indicating on the body’s website on the Internet mandatory information explaining the methodology for calculating the cost of certification services, and information about the certification body’s employees involved in performing work to confirm compliance, indicating work experience and education in this field. areas.

For employees of testing laboratories, the minimum work experience criterion for admission to activities related to measurements (research) under the supervision of mentors (with the exception of signing protocols) has been reduced. Now this may be a person who does not meet the requirements of the accreditation criteria and is registered as an internship until he achieves the required length of service and experience in a given area of ​​accreditation in accordance with the requirements of the accreditation criteria.

On organizing work on certification of hazardous waste

In accordance with the Regulations on the Federal Service for Environmental, Technological and Nuclear Supervision, approved by Decree of the Government of the Russian Federation of July 30, 2004 N 401 (Collection of Legislation of the Russian Federation 2004, N 32, Art. 3348) I order:

1. Approve the attached Procedure for organizing work on certification of hazardous waste.

2. The head of the Department of State Environmental Supervision, heads of territorial bodies of the Federal Service for Environmental, Technological and Nuclear Supervision shall ensure the implementation of this order.

3. The directors of the federal state institutions "Center for Laboratory Analysis and Technical Measurements" (FGU "TsLATI"), the federal state institution "Federal Center for Analysis and Assessment of Technogenic Impact" (FGU "FCAO") shall provide information and analytical activities related to the activities of the Department of State environmental supervision and territorial bodies of the Federal Service for Environmental, Technological and Nuclear Supervision for certification of hazardous waste.

4. The Department of State Environmental Supervision (A.I. Masalevich) should provide:

coordination of activities for certification of hazardous waste;

organizing work on collecting paper and electronic reports from territorial bodies of the Federal Service for Environmental, Technological and Nuclear Supervision on the certification of hazardous waste;

submission to the Federal State Institution "FCAO" of reports from territorial bodies of the Federal Service for Environmental, Technological and Nuclear Supervision on the certification of hazardous waste for their generalization and systematization in accordance with paragraph 6 of this order.

5. The Department of State Environmental Supervision (A.I. Masalevich) together with the Federal State Institution “FCAO”, within one month from the date of receipt of this order, prepare:

reporting form for territorial bodies of the Federal Service for Environmental, Technological and Nuclear Supervision on certification of hazardous waste;

proposals for maintaining the federal classification catalog of waste and making additions to it.

6. To assign to the Federal State Institution "FCAO" the functions of information and technical support for maintaining the federal classification catalog of waste and making additions to it and its systematization at the federal level, as well as summarizing and systematizing reports of territorial bodies of the Federal Service for Environmental, Technological and Nuclear Supervision on the implementation of certification of hazardous waste.

2.2. Individual entrepreneurs and legal entities whose activities generate hazardous waste are required to confirm that the waste is assigned to a specific hazard class.

The hazard class of waste for the natural environment is established depending on the degree of harmful impact on the natural environment in accordance with the Criteria for classifying hazardous waste as an environmental hazard class, approved by Order of the Ministry of Natural Resources of the Russian Federation dated June 15, 2001 N 511 (does not require state registration in accordance with the conclusion of the Ministry of Justice of the Russian Federation dated July 24, 2001 N 07/7483-UD).

2.3. Certification of hazardous waste is carried out by the Federal Environmental Service (hereinafter - Rostechnadzor) and its territorial bodies on the basis of information provided by individual entrepreneurs and legal entities in the course of whose activities hazardous waste is generated (hereinafter - applicants) and including information on the origin, composition, properties waste, conditions and specific waste disposal sites, technologies for their use and disposal, as well as materials classifying waste as a specific hazard class for the natural environment.

2.4. Activities for certification of hazardous waste include:

Preparation by applicants of information on the origin, composition, properties of waste, specific waste disposal sites, technologies for their use and neutralization and materials for classifying waste as a specific hazard class for the natural environment;

Review by Rostekhnadzor and its territorial bodies of materials submitted by applicants on the origin, composition and properties of waste, conditions and specific waste disposal sites, technologies for their use and neutralization, classification of waste to a specific hazard class for the natural environment, and preparation of documents confirming (non-confirming) ) assigning waste to a specific hazard class for the environment;

Registration and issuance by territorial bodies of Rostechnadzor of documents confirming the classification of hazardous waste as a waste hazard class for the environment (hereinafter referred to as a certificate of waste hazard class for the environment) according to the sample (to this procedure);

Coordination of hazardous waste passports.

2.5. Information, including information about the origin, composition, properties, conditions and specific waste disposal sites, technologies for their use and disposal, is prepared by the applicant and entered into the "Initial information about waste" according to the sample (to this Procedure) for each type of waste:

2.5.1. information about the state of aggregation and physical form is indicated on the basis of a visual inspection and/or the results of examinations, studies and measurements performed by a laboratory accredited for conducting quantitative chemical analyzes;

2.5.2. the component composition of the waste is indicated on the basis of sampling and analysis protocols performed by a laboratory accredited for conducting quantitative chemical analyzes, as well as information on the component composition of the feedstock and the technological processes of its processing. For waste represented by goods (products) that have lost their consumer properties, information on the component composition of the original product (product) is indicated in accordance with technical specifications, etc.;

2.5.3. to determine the origin of waste, the name of the technological process as a result of which the waste was generated, or the process as a result of which the product (product) lost its consumer properties, indicating the original product (product);

2.5.4. hazardous properties of waste are established in accordance with the requirements of Annex III to the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and Their Disposal, ratified by Federal Law of November 25, 1994 N 49-FZ "On Ratification of the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and Their Disposal removal" (Collected Legislation of the Russian Federation, 1994, No. 31, Art. 3200), and/or the requirements of relevant technical regulations, technical conditions;

2.5.5. information about the conditions and specific waste disposal facilities includes waste storage methods, including the containers (packaging) used, characteristics of the waste disposal facility, when placing waste in a waste disposal facility (a specially equipped structure designed for waste disposal (landfill, sludge storage facility, tailings storage facility, rock dump, etc.), the information about the waste disposal facility indicates the code of the administrative-territorial entity (OKATO) on the territory of which the specified waste disposal facility is located;

2.5.6. in the position on the method of use or neutralization of hazardous waste, the method used directly by the applicant (owner of the waste), the name of the site (production, process) where the use or neutralization of hazardous waste is carried out, indicating the specialized installations used for these purposes, in the event that the waste is not used or neutralized by the owner of the waste, but is transferred for subsequent use or neutralization to a specialized organization that has a license to collect, use, neutralize, transport, dispose of it, information about the transfer of this waste is entered;

2.5.7. in the “Additional information” position, the measures taken to prevent and eliminate the consequences of emergency situations associated with this hazardous waste, the containers or packaging methods used, the methods and conditions for storing the waste, the method of using or neutralizing this type of waste are indicated.

2.6. Materials for classifying waste into a specific environmental hazard class are prepared by the applicant in accordance with the Criteria for classifying hazardous waste as an environmental hazard class, approved by Order of the Ministry of Natural Resources of the Russian Federation dated June 15, 2001 N 511.

2.7. The document confirming the classification of waste to a specific hazard class for the natural environment is specified in paragraph 2.4. certificate of waste hazard class for the environment, which is issued for each specific type of waste.

2.8. A hazardous waste passport is issued for each specific type of hazardous waste according to the form and in accordance with the instructions for filling it out, approved by Order of the Ministry of Natural Resources of Russia dated December 2, 2002 N 785 (registered with the Ministry of Justice of the Russian Federation on January 16, 2003, registration N 4128 ).

2.9. Validity period of hazardous waste passport:

For waste included in the Federal Waste Classification Catalog (hereinafter - FKKO), approved by Order of the Ministry of Natural Resources of the Russian Federation dated December 2, 2002 N 786 (registered with the Ministry of Justice of the Russian Federation on January 9, 2003, registration N 4107), is not established ;

For waste not included in the FWCC, it is limited for the period of registration of this waste in the FWCC.

2.10. The applicants confirm the immutability of the technological processes and raw materials used in accordance with the Decree of the Government of the Russian Federation of June 16, 2000 N 461 “On the Rules for the development and approval of draft waste generation standards and limits on their disposal” (Collected Legislation of the Russian Federation, 2000, N 26, Art. 2772, 2006, No. 52, Art. 5587).

2.11. In case of changes in the technological process and composition of the raw materials used, the applicant prepares materials for certification of hazardous waste in accordance with paragraph 2.4. real order.

3. Organization of work on certification of hazardous waste

3.1. For the certification of hazardous waste, the territorial bodies of Rostechnadzor consider the following documents and materials submitted (in two copies on paper and in electronic form) by applicants:

3.1.1. For types of waste registered with the FKKO:

Application for the issuance of a certificate(s) on the hazard class of waste for the environment and approval of a hazardous waste passport(s), which indicates: a list of waste, full and (if available) abbreviated name, including company name , organizational and legal form, location, state registration number of the record on the creation of a legal entity and data from a document confirming the fact of entering information about a legal entity into the unified state register of legal entities, taxpayer identification number, information about the location of a separate production territory (hereinafter referred to as the application );

Materials specified in clause 2.5. this Procedure;

A copy of the laboratory accreditation certificate and its appendix indicating the relevant area of ​​accreditation, with the help of which the component composition of the waste was determined and studies were carried out to assign the waste to a specific hazard class for the natural environment;

Hazardous waste passport(s).

3.1.2. For types of waste not registered with the FKKO:

Application for the issuance of certificate(s) on the hazard class of waste for the environment and approval of the passport(s) of hazardous waste indicating in it: a list of waste, full and (if available) abbreviated name, including company name , organizational and legal form, location, state registration number of the record on the creation of a legal entity and data from a document confirming the fact of entering information about a legal entity into the Unified State Register of Legal Entities, taxpayer identification number, information about the location of a separate production territory (hereinafter referred to as the application );

Materials specified in this Procedure;

Copies of the laboratory accreditation document and its annex indicating the relevant area of ​​accreditation;

Hazardous waste passport(s).

3.2. The territorial body of Rostechnadzor accepts the application and other documents and materials specified in this procedure (hereinafter referred to as the applicant’s materials) on the day of receipt according to the inventory, a copy of which with a mark on the date of receipt of the applicant’s specified materials is sent (handed) to the applicant.

3.3. Applications are registered by the territorial body of Rostechnadzor.

If the information specified in the applicant’s submitted materials is incomplete and (or) the materials are incomplete, the territorial body of Rostechnadzor shall notify the applicant in writing within 5 days from the date of receipt of the applicant’s materials.

3.4. After checking the completeness of the materials in accordance with this Procedure, the territorial body of Rostechnadzor will organize a review of the applicant’s materials, including checking the accuracy of the information provided about the waste.

3.5. The territorial body of Rostechnadzor, within 30 days from the date of registration of the applicant’s materials, provides in accordance with clause 3.4. of this Procedure, consideration of the applicant’s materials specified in and issuance of certificates on the hazard class of waste for the environment and approved hazardous waste passports, or sending the applicant a notice of refusal to issue these documents indicating the reasons for the refusal.

The grounds for refusal to issue a certificate of the hazard class of waste for the environment and approval of a hazardous waste passport (for types of waste registered with the FKKO) may be:

The presence (detection as a result of an independent expert assessment carried out in an accredited laboratory) in the submitted materials of the applicant of unreliable or distorted information about the composition of the waste and/or its properties, including the hazard class of the waste for the environment.

3.6. Based on the applicant’s materials specified in this Procedure, the territorial body, after checking their completeness and accuracy, ensures, within 15 days from the date of their registration, the submission of the 2nd set of materials (on paper and in electronic form) to Rostekhnadzor to organize a verification of the validity of the determination hazard classes of waste for the environment.

3.7. Rostechnadzor organizes the review of materials submitted by territorial bodies and sends them to verify the validity of establishing waste hazard classes for the environment and their identification to the Federal Center for Analysis and Assessment of Technogenic Impact (hereinafter referred to as FGU FCAO).

3.8. Based on the results of the verification of the validity of establishing the hazard classes of waste for the natural environment, carried out by the Federal State Institution "FCAO", Rostechnadzor sends to the territorial body no later than 45 days from the date of receipt of the specified materials, information on the results of the verification of the validity of establishing the hazard class for the environment (on confirmation or non-confirmation of the hazard class of waste for the natural environment of waste not registered with the FKKO) identification of waste, for the issuance by the territorial body of Rostechnadzor of a certificate on the hazard class of waste for the natural environment, or on refusal to confirm the hazard class of waste for the environment natural environment.

3.9. The territorial authority, within 10 days from the moment of receiving information from Rostechnadzor, notifies the applicant and ensures the issuance of certificates on the hazard class of waste for the natural environment and approval of hazardous waste passports, or sends the applicant a notice of refusal to issue a certificate on the hazard class of waste for the natural environment and approval of a hazardous waste passport indicating the reasons for refusal.

The grounds for refusal to issue a certificate of the hazard class of waste for the environment and approval of a hazardous waste passport (for types of waste not registered with the FKKO) may be:

Incompleteness of materials;

Incompleteness of the information provided;

The presence (detection as a result of an independent expert assessment conducted in an accredited laboratory) in the submitted materials of the applicant of unreliable or distorted information about the composition of the waste and/or its properties, including the hazard class of the waste for the environment;

Identification, when checking the validity of waste hazard classes for the natural environment, of errors in establishing a specific waste hazard class for the natural environment using calculation and/or experimental methods.

3.10. Based on the results of an inspection carried out in accordance with this Procedure, if the validity of classifying waste types as environmental hazard classes is confirmed, the Federal State Institution "FCAO" prepares proposals for assigning a code to this waste in accordance with the FKKO and making additions to the FKKO, and sends these proposals to Rostekhnadzor.

3.11. After the hazardous waste is entered into the FKKO and the amendments to the FKKO are approved in the prescribed manner, the certificates previously issued by the territorial body of Rostechnadzor about the hazard class of the waste for the environment and a hazardous waste passport with a limited validity period are subject to re-issuance upon the expiration of the validity period of this passport. The applicant may apply to the territorial body of Rostechnadzor to re-issue the passport before its expiration.

3.12. The territorial body of Rostechnadzor registers an application for re-issuance of the certificate of the hazard class of the waste for the environment and approval of the hazardous waste passport due to its expiration and registration of the waste with the FKKO. The application must be accompanied by the originals of the previously issued hazardous waste passports and the certificate of the waste's hazard class for the environment. A copy of the application with a mark on the date of receipt of the applicant’s specified materials is sent (handed) to the applicant.

3.13. The territorial body of Rostechnadzor, within 5 days, reviews the application and its annexes submitted by the applicant in accordance with this procedure, notifies the applicant of the results of the review and ensures the issuance of a re-issued certificate of the hazard class of the waste for the environment and an agreed hazardous waste passport. The originals of previously issued hazardous waste passports and certificates of waste hazard class for the environment are subject to write-off and destruction in the prescribed manner.

3.14. The territorial bodies of Rostechnadzor register issued certificates on the hazard class of waste for the natural environment and hazardous waste passports in the registration log, ensure storage and archiving of materials submitted by the applicant, as well as copies of issued certificates on the hazard class of waste for the natural environment and hazardous waste passports.

3.15. Territorial authorities quarterly (by the 15th day of the month following the reporting period) submit to Rostechnadzor a report on the work on certification of hazardous waste.
