Products of inadequate quality cannot be returned. List of non-food products of proper quality that cannot be returned or exchanged for a similar product of a different size, shape, size, style, color or configuration

What products cannot be exchanged or returned? Is there any law that regulates the relationship between the seller and the buyer? What can you return when making a purchase? How to do it? Understanding all this is not as difficult as it seems. In Russia, not all goods can be returned if they are of high quality. Therefore, buyers must clearly understand in what situations they will have to make sure that the products are 100% necessary. There is a special law in the country. It regulates the procedure for returning and exchanging goods of good quality, and also indicates a complete list of products that cannot be exchanged or returned under any circumstances. So what should every buyer know? How to protect yourself from deception?

Why can't I return it?

The first step is to understand why in Russia there are goods that cannot be returned or exchanged. It has already been said that returns and exchanges are possible when the product does not meet quality standards. But if the requirements are fully met, it will not always be possible to return it. And exchange too.

Some types of consumer products cannot be returned or exchanged due to their properties. For example, toothpaste. A person buys it, uses it once, then returns it to the store and exchanges it for another. Or, for example, a toothbrush. First it was purchased, then unpacked and tested. The buyer decided that the brush was not suitable for him (too soft or hard) and returned it. No one will want to buy a used toothbrush again.

That is why it is important to understand which products cannot be exchanged or returned. Of course, it is important that we are talking about products of appropriate quality. If a defect or any flaws are found, the product can be exchanged or returned.

When can I return an item?

Many buyers know that within 14 days after purchasing a product, they have the opportunity to return the purchase. But as already mentioned, citizens do not always have such a right. Exchange and return of goods takes place if:

  • does not fit in shape, size or style;
  • the buyer received the wrong or incomplete package;
  • The wrong color of the item was received.

The basis for this is the Law “On the Protection of Consumer Rights”, Part 1 of Article 25. In fact, you can exchange, as already mentioned, any thing. But there are exceptions. Which items cannot be exchanged under any circumstances?

Hygiene and personal use

So, the first category is items for personal hygiene and personal use. For example, this, as already mentioned, includes toothpaste and a brush. A variety of curlers, combs, hairpins, hair brooches, wigs and other similar products - all this is not subject to return or exchange.

The exception is the discovery of defective products. But proving it will be very problematic. Therefore, as practice shows, it is impossible to return such products. And exchange too. Especially if it was used by the buyer.

What products cannot be exchanged or returned? Here are a few more very common things that are found in stores and are not exchanged:

  • shaving foam and lotion;
  • shampoos;
  • soap;
  • bubble bath;
  • bath salt;
  • diapers;
  • creams;
  • shower gels.

In fact, all of these are bath accessories designed to care for human skin.

Treatment and prevention

The next category of non-food products is nothing more than items intended for home treatment and the prevention of any diseases. What products are not subject to exchange or return from this category?

The following products can be classified as such products:

  • mouth rinses;
  • medicated toothpastes (professional);
  • medical masks;
  • sanitary items;
  • medical equipment;
  • medical instruments;
  • baby powder;
  • items for newborn care;
  • medicines.

Accordingly, if a citizen bought, for example, a medicine for the flu, but he needs painkillers, no one will accept the purchase back. You'll have to keep it and spend money again.

Sewing and textile goods

What products cannot be exchanged or returned? The thing is that in addition to the listed categories, there are also clothing and textile products. It is also not subject to exchange or return. The exception is clothing. But it is customary to separate it into a separate product category. What does the law on product returns say?

Sewing and textile goods that are not subject to return or exchange include:

  • underwear;
  • hosiery goods;
  • knitwear;
  • fabrics (synthetics, linen, cotton, silk, wool);
  • non-woven products (ribbons, ribbons, lace).

That is why it is recommended to carefully select the listed products. Quite often, citizens try to return their underwear. For example, if it doesn't fit in size. This, as has already been said, cannot be done. The Law on Return of Goods prohibits the exchange or refusal of goods that meet all quality standards.

For home

  • furniture;
  • household chemicals;
  • pesticides;
  • chemicals.

Cosmetics and perfumes

What products cannot be exchanged or returned? In addition to everything previously listed, it is worth paying attention to two more categories of purchases. These are cosmetics and perfumes. Such products are not exchanged. And it will also not be possible to return her under any pretext.

Any cosmetics are taken into account: both medicinal and decorative. Perfume is also unimportant - for men or for women. The main thing is that these items cannot be returned/exchanged. There are exceptions, but they are very rare. For example, when expired products are sold and the buyer did not know about it. But then the product will no longer be of adequate quality.

Equipment and weapons

But that's not all. Items that cannot be returned may be complex equipment or weapons. It can be returned or exchanged only when covered by the warranty. Otherwise, it will not be possible to bring the idea to life.

For example, you cannot return:

  • telephones;
  • TVs;
  • cameras;
  • video cameras;
  • electronic toys;
  • gaming consoles;
  • computers;
  • gas appliances;
  • power tools;
  • cartridges;
  • civilian weapons and their components;
  • woodworking and metal-cutting items.

Other

This does not end the list of products that cannot be returned or exchanged after making a purchase. It is worth paying attention to the fact that the law “On Return of Goods” also suggests not accepting returns from buyers:

  • animals;
  • plants;
  • newspapers;
  • magazines;
  • jewelry;
  • cars and their components;
  • motorcycles and their parts;
  • vessels and swimming equipment;
  • any non-periodical publications;
  • cable products (including wires and cords);
  • materials for finishing and construction (carpets, linoleum, films);
  • products sold by the meter.

This is all an exhaustive list. The seller cannot expand the established list at his own request. Additionally, grocery items cannot be returned. There are exceptions, as has already been emphasized. For example, if the product was “punched” by mistake or was found to be of inadequate quality.

How to return an item

How can I return products? To do this you need:

  1. Identify poor quality.
  2. Pack the goods completely.
  3. Contact the store with a receipt and warranty card (if you have one). 14 days are allowed for exchange or return.
  4. Write a return request and wait for the results of the product inspection. If there is evidence of inadequate quality, it is worth attaching it. As a rule, goods cannot be exchanged without a receipt.

Currently in Russia, the consumer in relations with the manufacturer and seller is endowed with a wide range of rights. The Law of the Russian Federation “On the Protection of Consumer Rights” (ZOPPP) No. 2300-1, adopted back in 1992, establishes for the latter serious obligations to ensure the quality of products and the awareness of ordinary citizens regarding their properties. And these rules are imperative, that is, local authorities, including in Moscow and St. Petersburg, do not have the right to change them.

However, many provisions of the law require additional consideration; they are clarified by by-laws, which must be considered in their entirety. For example, the list of goods that are not subject to return and exchange in 2018-2019 according to the law of the Russian Federation is not directly established; it must be found in Government Decree No. 55 of January 19, 1998, which has been amended more than once. We will tell you in more detail which products are not subject to return and exchange according to the law of the Russian Federation. The list for 2018-2019 is inside the article.

Consumer rights to replace an item without visible defects

According to Art. 25 of the PLA, the buyer, within 14 days from the date of purchase of the item (not counting the day of purchase), has the right to exchange it for a similar product of a different size, style, shape, color, as well as configuration or dimensions. This is allowed only if the item has not been used, all seals and labels have been preserved, and the consumer has a cash or sales receipt (or other document confirming the fact of purchasing the goods from a specific seller). Witness testimony can also be used as evidence, subject to the consent of both parties.

If a similar product suitable for the buyer is not on sale on the day of application, the citizen has the right to demand termination of the contract with all the ensuing consequences: the return of the item to the store and the money paid for it to the buyer.
However, there is a list of goods that cannot be returned or exchanged within 14 days on the grounds that the product does not fit the style, shape, color, dimensions or configuration. That is, we are talking about goods of proper quality. They cannot be returned within 14 days, which is due either to their specific properties or other logical considerations of the legislator. This list was approved, as mentioned above, by Decree of the Government of the Russian Federation No. 55 of January 19, 1998

What products cannot be returned?

List of goods that are not subject to return and exchange in 2018-2019 according to the law of the Russian Federation:

  1. goods intended for use for preventive purposes, purchased in pharmacies, but used at home (for example, sanitary and hygiene items made from various materials, medical devices and apparatus, lenses, children's cosmetics, items for the care of newborns and young children) ;
  2. products intended for personal hygiene;
  3. Perfumes and cosmetics;
  4. fabrics and accessories, cable products, construction and finishing materials, the sale of which is carried out on a per-meter basis; sewing and knitted underwear and hosiery;
  5. products and materials intended for storing or interacting with products, made entirely or partially from polymers (dishes, special containers, packaging, including disposable ones);
  6. household chemicals;
  7. furniture intended for use in everyday life, both individual items and sets, sets;
  8. pesticides, agrochemicals;
  9. jewelry, products made of precious metals and precious stones, including faceted precious stones or inserts;
  10. cars, as well as pleasure craft and watercraft intended for domestic use only, trailers, mobile agricultural machinery;
  11. complex technical products with warranty periods;
  12. civilian weapons;
  13. The legislator also classifies animals as non-food goods that cannot be exchanged; it is quite logical that plants cannot be replaced with a similar product of a different color;
  14. books, maps, other non-periodical publications.

Resolution 55 in paragraph 11 of the above list provides a list of technically complex goods, which includes machine tools, electrical appliances, photographic and film equipment, radio-electronic equipment, gas equipment, computing, duplicating and fax equipment, telephones, electric musical instruments and electronic toys, even wristwatches with several functions . At the same time, by Decree of the Government of the Russian Federation No. 924 of November 10, 2011. a separate, more detailed list of technically complex goods was introduced.

Consumer rights in relation to goods from the List

Any goods included in the list of goods of good quality that are not subject to return and exchange according to the law of the Russian Federation in 2018-2019 can in fact be returned, but on the condition that deficiencies are found in them. Return rules and terms are regulated by Art. 18 PDO.
However, it is worth remembering that they cannot be cited as shortcomings on the basis of Art. 25

  • style;
  • size;
  • equipment;
  • dimensions;
  • form;
  • colors.

Changes to the list and final provisions

The list of goods of good quality that cannot be exchanged or returned has not changed in 2019; in general, the amendments to this document were quite few. Major changes were made at the end of 1998; in 2015, jewelry was added to the list; in 2016, the list of technically complex goods and goods intended for storing and using food products was edited (clause 6).

When determining which goods cannot be returned within 14 days and when forming the corresponding list, the legislator used the term “non-food”, thus these restrictions do not apply to food products.

In practice, difficulties arise when classifying goods into one type or another, especially for technically complex goods. If you cannot reach an agreement with the seller, you should not be afraid of litigation. Numerous judicial practices in most regions of the Russian Federation, including St. Petersburg, Moscow, and the Moscow region, are on the consumer’s side. Especially if the consumer is represented in court by an experienced lawyer.

Hello friends! The following story happened to me: I decided to buy perfume as a gift for a friend. I came to the store, chose the scent I liked, and paid. At the checkout, just in case, I asked if it would be possible to return the perfume or exchange it for another one if the smell suddenly didn’t suit me. The answer was negative; it turns out that, according to the law, perfumes cannot be returned to the store. The perfume was quite expensive, and I was worried until the actual presentation of the gift. Fortunately, the girl liked the scent, and the money was well spent. However, I decided to study list of goods that cannot be returned or exchanged, so as not to take any more risks.

What laws govern consumer rights when replacing a purchase?

The provisions that sellers must follow are set out in the Law on the Protection of Consumer Rights. He stipulates that Most purchased items can be exchanged for similar ones or returned within 14 days from the date following the transaction. How can you justify wanting to return an item? It didn’t suit the color, size, configuration, I just didn’t like it - any of these arguments will do. Your rights in such cases are defined in Article 25 of the relevant law.

True, part 1 stipulates the following conditions for the return of serviceable items:

  • presence of a sales or cash receipt remains an unchanged rule, because otherwise you will not be able to prove that you made a purchase from a particular seller;
  • the item must retain its original appearance(signs that it has been in use will be a reason to refuse replacement);
  • it is necessary to ensure the safety of seals and labels.

What to do if you don't have a receipt? The Consumer Rights Protection Law allows returns based on testimony. Simply put, you must have people with you confirming that you made a purchase at a particular store.

Check if the item you purchased is on the list of items that cannot be exchanged

If you want to return a product that turns out to be of poor quality, you will have more rights. They are set out in Article 18 the same law, with the latest edition dating back to 2018. If in the previous case you are obliged first of all to make an exchange for a product that meets the criteria, then if defects are identified, count on the following:

  • return the product to the store for free repair;
  • exchanging a non-working item for a normally functioning one;
  • replacement with another model with additional payment or refund of part of the funds;
  • receiving part of the money paid back;
  • complete termination of the transaction and return of all funds.

Part 1 of Article 18 stipulates that you also have the right to demand compensation for losses if they resulted from the inadequate quality of the purchased product.

What does Resolution No. 55 say?

Although in most cases you will exchange items, some items cannot be returned due to the nature of their properties. The list is enshrined in Resolution No. 55, dated January 19, 1998. The text has been updated several times, so find out what's included in 2018.

Which products cannot be returned or exchanged after purchase?

Surely you have seen advertisements that goods cannot be returned or exchanged. How much do they comply with the law? In most cases, such statements are unlawful. To ensure that a product cannot be returned or exchanged, it must be included in the list established in the Government Decree of 1998.

General list of goods that cannot be returned or exchanged

The list of non-food products includes the following:

  • items used for personal hygiene(testing a comb or toothbrush and then making a claim will not work for obvious reasons);
  • medicines and medical devices(violation of the integrity of the packaging will affect the quality);
  • childen's goods(diapers, pacifiers, bottles are classified as personal use items);
  • underwear and bed linen(cannot be exchanged due to hygiene reasons);
  • perfumes and cosmetics(you will return it to the store only if defects or counterfeits are detected);
  • fabrics and tapes, if they are sold by the meter (exceptions are possible when purchasing a whole roll);
  • wires and cords;
  • Construction Materials, if they are sold by linear meters (when purchasing a roll of carpet or linoleum, it is possible to negotiate a return);
  • cars and other vehicles;
  • books and other non-periodic products;
  • jewelry(to avoid counterfeits when returning);
  • animals;
  • technically complex products, including PDA;
  • pesticides and household chemicals;
  • polymer dishes;
  • civilian weapons, including cartridges;
  • pieces of furniture.

Find out in advance whether your purchase is on the list of goods that cannot be returned to the store. If this option is not provided for by law, make your choice responsibly, especially when it comes to expensive items.

In practice, the rules are less stringent. For example, the store administration in most cases allows you to return furniture and other things if they remain presentable. As for children's products, it is necessary to delve into the specific case. After all, things for newborns (bodysuits or undershirts) are put on the child’s naked body, therefore, they are classified as “underwear”: returning them to the store is not allowed by law. But outerwear (warm overalls) must be changed within 2 weeks, even if the buyer does not like the color.

In some cases, the product included in the list can be returned: you will see the process in the video.

Reader question: is it possible to return perfume to the store?

Hello! I bought expensive perfume at the store, “Chanel Chance”, and paid 7,500 rubles. But as soon as I opened the bottle, I felt that the smell was different from the original. I have a receipt, but perfumes are on the list of goods that cannot simply be returned. Does this mean I have to accept losing money?

According to Decree No. 55, simply citing dissatisfaction with the product when it comes to perfume products is not allowed. But in your case, consumer rights are protected by Article No. 10 of the relevant law, since you were provided with false information about the product. First, submit a written complaint to the store and inform them that you are going to conduct an authenticity examination. If you were sold a fake, at this stage the issue will most likely be resolved.

The administration didn't cooperate? Contact the Chamber of Commerce and Industry and the manufacturer of the original, and after confirming that you were sold a fake, go to court with a claim for recovery of funds. But keep in mind that the examination will be expensive: order it if you are 100% sure that you are dealing with a fake.

Technically complex products included in the list: why cannot be returned to the store

The list of goods considered as technically complex was defined in the Resolution of October 10, 2011. It included the following:

  • light aircraft, and they can be equipped with an internal combustion engine or an electric motor;
  • cars;
  • tractors, walk-behind tractors and other agricultural machinery, if it is equipped with an internal combustion engine;
  • snowmobiles same type;
  • sports vessels, yachts, boats, and with an internal combustion or electric engine;
  • computers, laptops, printers, monitors, game consoles;
  • TVs;
  • cameras;
  • video cameras;
  • satellite TV kits;
  • refrigerators, electric stoves and other kitchen and household appliances with an electric motor or microprocessor automation.

Returns in such cases are accepted if you find a defect. But this does not mean that in practice sellers do not deviate from the rules: not wanting to lose customers, they meet them halfway. The main thing is that you ask and not insist, and you will be able to reach an agreement.

Reader question: if there is a problem with your smartphone

Hello! The following problem arose: I bought a smartphone that was not cheap for me, and spent six months with it. After 6 months, the screen brightness began to disappear, and the seller suggested sending the device for examination. This is all great, but I need a working device. How to return your smartphone and get money back?

Today it is impossible to immediately return the cost of the device. First of all, a smartphone is considered a technically complex product, so it will not be possible to return it without serious reasons. It is also important that six months have passed from the date of acquisition, not 14 days. But there is a loophole, although you will have to be patient.

Take your smartphone to the seller and complain about it being broken. You will be asked to write a statement where you state the reasons for your application and set the date. Be sure to take a copy for yourself, on which the seller will also sign. The device will be sent to the service center for examination: if it takes more than 45 days, you will have the right to demand termination of the purchase and sale agreement. The basis will be the fact that the seller has exceeded the maximum period that the law allocates for eliminating the defect.

List of pharmaceutical products that are not subject to exchange or return

In most cases, medical and medicinal products cannot be returned, since their properties do not make it possible to determine whether they were used by the buyer. Violation of the integrity of the packaging also plays a role, which will interfere with further sales. The list includes the following:

  • instruments for medical manipulations, including syringes, heating pads and enemas;
  • various devices(blood pressure monitors, breast pumps, hearing aids may be returned to the pharmacy only if they are not working correctly);
  • hygiene products, including napkins, condoms, medical gloves;
  • glasses lenses;
  • disinfection products;
  • diapers, diapers and other goods necessary for the care of small children;
  • medications.

Therefore, if you bought unexpired tablets, ointments or powders, and then try to take them to the pharmacy, the pharmacist has the right to refuse you.

Why are medicines not allowed to be returned? The fact is that the buyer can change the chemical composition of the contents or replace it with a cheaper drug.

When can you return food products: list of articles of the law

Unlike the group of non-food products, everything is simple in this area. Articles 18 and 25 of the Law “On Protection of Consumer Rights” stipulate that if the quality of food is proper, food products cannot be returned to the seller.

When items on the list can still be returned

The purchase made can be returned to the store if it turns out to be defective. Defects will be grounds for refusal to purchase, even when the seller has posted an announcement that the goods will not be accepted back. Insist on your point, citing Article 18 of the Law “On Protection of Consumer Rights”. But be prepared that the seller will first offer to correct the defects at his own expense or exchange the item for one of similar quality and value.

Children's clothes and underwear are on the list of goods that cannot be returned to the store

In practice, the procedure cannot be called easy, since the seller organizes an examination. For example, you bought a video camera and discovered that it does not work. Since the purchase is a technically complex device, normal returns are no longer possible. In this case, the cause will be a breakdown, but the product must be sent to a service center. Specialists will assess its condition and find out that the shortcomings are not related to improper operation.

At the next stage, your product will be repaired at the manufacturer’s expense. The process should take no more 45 days; if the manufacturer does not meet this deadline, you will finally be able to receive the funds paid.

Discounted goods: are returns or exchanges allowed?

When items are sold at a reduced price, sellers often claim that returns are not possible. But changes in price or the presence of a discount will not be grounds for breaking the law.

In fact, markdowns are made for various reasons:

  • the administration of the retail outlet wants to get rid of stale items or attract buyers;
  • The products offered have hidden defects.

In the latter case The seller is obliged to warn about the presence of a defect. If you bought perfume on sale, but you were informed that the packaging was damaged, then this factor cannot become the basis for a return or exchange. Have you discovered additional shortcomings that you weren’t aware of when making the purchase? You have the right to demand your money back or take another bottle with an additional payment. But the administration of the retail outlet can carry out an examination of the product, and if it does not find any defects, its cost will have to be covered by the unlucky buyer.

You can learn more about returning and exchanging goods that are not included in the list from the video:

Return or exchange of goods of inadequate quality from the list: if they don’t want to give you the money

Have you discovered a defect in a non-returnable item and want to get your money back? First, contact the seller with a verbal complaint. If he refuses an exchange or refund, write a claim in 2 copies. Stick to the following pattern:

  • indicate the addressee; when you do not know the full name of the director of a retail outlet, use the wording “To the store manager”;
  • write yours Full name, address, contact phone number;
  • in the middle of the next line - "Claim";
  • describe the situation, indicate the name of the product, date of purchase and defect found;
  • state the essence of your wishes(exchange, refund);
  • put signature and date.

According to the law, the seller has 10 days to resolve the issue. If he doesn't take action, go to court. Knowing how to write an application for compensation of funds, you will achieve results.

Reader question: purchasing non-returnable goods in an online store

I purchased a monitor from an online store, paid for it, and tried it out. But after 2 days of use I realized that the thing absolutely does not suit me. After just 2 hours of use my eyes hurt, so I want to return or exchange for another model. Alas, although I still have the documents, it is unlikely that I will be able to get the money back, because the monitor works without failures. What to do in such a situation? On the seller's website I saw that it works without returns.

If you entered into a transaction with an online store, then your rights are regulated by the Decree of the Government of the Russian Federation “On approval of the rules for the sale of goods remotely.” The law allows you to refuse the purchase if you have not yet received the monitor in the mail. Even if you have started using it, you have 7 days to make a final decision. The main condition for a return will be the preservation of the appearance and quality of the purchased item. As for the refund, the store is obliged to pay the entire amount, excluding shipping costs. Your task at this stage is to send a written claim within 7 days from the date you picked up the parcel at the post office.

Why can you send a purchase back to an online store? The fact is that For distance selling, the list of goods that cannot be exchanged or returned does not apply. There are no references to this document in the mentioned Decree of the Government of the Russian Federation. Also, Article 26 of the Law “On Protection of Consumer Rights”, which regulates trade via the Internet, does not provide them. Consequently, the relationship with the seller is based on the rules of distance selling, and they provide for the possibility of exchange or return. What is written on the website of the online store should not interest you: its owner has no right to violate the law. Distance selling is always a risk for the seller as he is left with rejected goods, but its difficulties should not affect buyers.

Conclusion

The laws of the Russian Federation establish a list of goods that are not subject to return or exchange. This means that a mistake when choosing a style, color or size will not be grounds for returning your purchase to the store. You will be able to get your money back only if you discover hidden defects: after the examination, you have the right to count on free repairs. If the manufacturer does not meet the deadline within 45 days from the date of your request, your money will be returned. In other cases, you won’t be able to get them back, so immediately evaluate the feasibility of the acquisition.

Consumers often ask the question: “Is it possible to exchange a purchased product if you don’t like it or don’t like it?” Moreover, we mean goods of proper quality, that is, not defective or expired.
