Who needs a production control plan

It is necessary to approve such an action plan before the start of the enterprise's activities. In some companies, it will be indefinite. It is necessary to change and supplement it according to the law only in the following cases:

  • the production technology has been improved or changed;
  • the list of materials used has changed.

Many are interested in who should draw up a production control program. Given that such work requires knowledge of both the current sanitary standards and the specifics of production, the task of drawing up an action plan is given to a well-trained person who has undergone certain training. In large companies, this is done by labor protection specialists who, even without the Internet, know whether workplaces are objects of production control. Small organizations and individual entrepreneurs can apply for a similar service to third parties. Sometimes it is much more profitable than independently studying all the information about the sanitary standards in force in a particular area and developing a full-fledged document.

What should be included in the control plan

A sample of the production control program at the enterprise 2019 (general form) is available for download at the end of the article. It contains all the necessary items that must be present in the document:

  • a list of sanitary rules and methods of analysis in force in a particular area;
  • list of responsible persons who carry out control activities;
  • a list of potentially dangerous factors, objects and works in production, possible emergencies;
  • an indication of positions for which a medical examination, hygienic training, certification is mandatory;
  • measures to justify and ensure safe working conditions;
  • a list of materials for accounting for ongoing activities and reporting to government agencies.

When preparing a document, one should be guided by the letter of Rospotrebnadzor dated April 13, 2009 No. 01 / 4801-9-32. It presents a typical production control program, including a list of measurements and studies, for enterprises:

  • Catering;
  • Food Industry;
  • consumer services;
  • organizations engaged in food trade;
  • medical institutions.

At the same time, the letter from Rospotrebnadzor lists facilities where it is not necessary to conduct laboratory and instrumental studies. Among them are offices, pharmacies, cinemas, hotels, shops selling industrial products.

For the lack of a program will be punished

There is no separate article in the current legislation under which the organization or its head would be held liable for the lack of a production control plan. Therefore, after inspections, Rospotrebnadzor can choose one or more "suitable" articles of the Code of Administrative Offenses of the Russian Federation. Among the most likely:

Production control on labor protection at the enterprise is a set of actions (including laboratory research and testing) to assess compliance with sanitary rules and the implementation of sanitary and anti-epidemic (preventive) measures.

The primary duty of the employer in relation to the staff is to create a safe working environment. To do this, a set of measures for labor protection is carried out. One of its important components is production control. Taking measures to organize labor protection is also the responsibility of the administration ( Art. 212 of the Labor Code of the Russian Federation).

Laws regulating the organization of control

Production control ensures compliance with the standards established by legislative acts and labor protection requirements; carried out at the enterprise, regardless of the results of the assessment of working conditions, the presence or absence of exceeding the norms of exposure to harmful factors.

The organization of the assessment of working conditions at the enterprise is regulated by four regulations (the last two are for hazardous production facilities):

  • Federal Law No. 52-FZ dated March 30, 1999;
  • Sanitary rules SP 1.1.1058-01 "Organization and conduct of production control ...", approved on 10.07.2001;
  • Federal Law No. 116-FZ dated July 21, 1997;

Objects

The obligation to conduct verification of compliance with the joint venture rests with all employers, without exception, whether they are legal entities or individual entrepreneurs. The objects of verification, according to clause 2.3 of SP 1.1.1058-01, can be:

  • industrial and public premises;
  • buildings and constructions;
  • sanitary protection zones;
  • sanitary protection zones;
  • equipment;
  • transport;
  • technological equipment and processes;
  • workplaces;
  • raw materials, semi-finished products, finished products and waste.

Depending on the specifics of the structure and scope of activity, each organization has its own list of objects. It defines the frequency of assessment, the methods used, benchmarks and their critical values, as well as responsible persons. From this information, a document is formed, the presence of which is required by labor protection - a production control program.

Who should conduct and what activities to include

The answer to this question is contained in Art. 32 FZ-52. In accordance with this norm, production control is carried out at the following stages of production and sale of goods and services:

  • production of products;
  • storage;
  • transportation;
  • vacation;
  • performance of work and provision of services.

At the same time, the law states that compliance with sanitary and epidemiological standards and the implementation of preventive measures are being checked. Thus, all enterprises engaged in the production and sale of goods, the provision of services, the performance of work, are required to carry out production control measures. This obligation applies to both legal entities and individual entrepreneurs in order to create proper working conditions for employees.

The list of activities carried out for these purposes:

  • laboratory research;
  • medical examinations;
  • checking the availability of documents, certificates, sanitary rules, etc.;
  • analysis of the safety of working conditions, new types of products, technologies;
  • reporting on PC and labor protection;
  • verification of compliance with sanitary rules, etc.

The list of measures in full is specified in clause 2.4 of SP No. 1.1.1058-01.

In addition, production control is carried out by enterprises operating hazardous production facilities (FZ No. 116-FZ of 07/21/1997). They are required to prepare and maintain a package of documentation, including the provision.

How often

In practice, taking into account the provisions of sanitary norms and rules, the frequency of production control of physical factors is adopted - once a year. The organization may designate the timing and specific timing of activities in the relevant PT program, depending on the nature of the factors to be tested. Law enforcers have not formed a unanimous opinion regarding the frequency. Rospotrebnadzor, in accordance with departmental decisions, does not consider offices to be PC facilities, which is not confirmed by sanitary standards. Some managers, on this basis, independently determine the mandatory nature of inspections, but the supervisory authorities may not agree with such an opinion.

Plan

The program is drawn up by the employer without fail before the start of activities or no later than 3 months from the date of approval of sanitary standards (clause 2.6. SP 1.1.1058-01). The document is drawn up in free form, but it must contain the following lists:

  • official sanitary rules and assessment methods in accordance with the activities carried out;
  • responsible officials;
  • potentially hazardous factors and objects of control;
  • positions subject to medical examinations, professional hygienic training and certification;
  • works and services, potentially hazardous products and activities;
  • substantiation of product safety and technology of its production;
  • safety criteria, harmlessness of factors of the production environment;
  • official forms of accounting and reporting;
  • possible emergencies due to production shutdown, violations of technological processes.

What is measured

Need to research:

  • noise level;
  • the presence of ionizing radiation, electromagnetic fields;
  • the presence of ultrasonic and infrasonic, mechanical vibrations;
  • degree and quality of illumination;
  • the ratio of local and general vibration;
  • microclimate parameters.

Responsible

The head of the organization has the right to assign the responsibility for supervision over compliance with sanitary rules to an employee of the enterprise that meets the requirements of the law. In accordance with Art. 217 of the Labor Code of the Russian Federation, the employer is obliged to introduce the position of labor protection engineer if the minimum number of employees is 50 people. Recommendations for the organization of this unit are contained in the Decree of the Ministry of Labor of the same name dated February 8, 2000 No. 14. It contains the widest list of functions of labor protection specialists, which is not limited to supervision. For example, the labor protection department also approves a report on production practice.

The responsibility for organizing events lies with the ecologist, health worker, it is also included in the professional standard of an OT specialist. Controlling and responsible persons must have special knowledge, the availability of which is confirmed by the relevant documents.

Section 1 of the Letter of Rospotrebnadzor dated 04/13/2009 No. 01/4801-9-32 lists enterprises that must necessarily perform laboratory and instrumental control (LIC) as part of production control. These include housing and communal services organizations, beauty salons, public catering organizations, service and trade companies, etc. All firms not listed in this letter may be limited to the results of SOUT.

Result

All results of the inspection of working conditions are recorded in a special journal, the form of which is an annex to the control program. This document should be in every organization. It records the results of inspections, analyzes their compliance or non-compliance with established standards. A voluminous document in A4 format must be laced and numbered. It is mandatory to indicate the record number, the object of verification and the date of the event. It is forbidden to remove sheets during amendments.

If violations are detected, the employer is obliged to take the measures provided for by the current legislation to eliminate them and prevent their recurrence (clause 5.1 of SP 1.1.1058-01). Information on the results of control is provided by an individual entrepreneur or a legal entity at the request of the authorities authorized to exercise state sanitary and epidemiological supervision.

Responsibility for violations

In the absence of local regulations confirming the implementation of production control measures, the organization may be held administratively liable for Art. 6.3 Administrative Code of the Russian Federation. Fines for citizens and individual entrepreneurs range from 100 to 500 and from 500 to 1000 rubles. Legal entities may be fined from 10,000 rubles to 20,000. It is also possible to apply such punishment as an administrative suspension of activities for up to 90 days.

6. General provisions

6.1. The production control program determines the procedure for organizing and conducting production control over compliance with sanitary rules and the implementation of sanitary and anti-epidemic (preventive) measures and provides for the obligations of the organization's officials to comply with the requirements of sanitary rules. 6.2. Working conditions, workplace and labor process should not have a harmful effect on a person. Requirements for ensuring safe working conditions for a person are established by sanitary rules and other regulatory legal acts of the Russian Federation. 6.3. Officials (heads of structural divisions of the organization) are obliged to exercise general control over the implementation of sanitary and anti-epidemic (preventive) measures to ensure safe working conditions for humans and the requirements of sanitary rules and other regulatory legal acts of the Russian Federation related to production processes and technological equipment, organization of workers places, collective and individual means of protection of workers, the regime of work, rest and welfare of workers, in order to prevent injuries, occupational diseases, infectious diseases and diseases (poisoning) associated with working conditions. 6.4. Working conditions with machines, mechanisms, installations, devices, devices that are sources of physical factors affecting a person (noise, vibration, ultrasonic, infrasonic effects, thermal, ionizing, non-ionizing and other radiation) should not have a harmful effect on a person. 6.5. Criteria for safety and (or) harmlessness of working conditions with sources of physical factors affecting a person, incl. maximum permissible levels of exposure are established by sanitary rules. 6.6. The use of machines, mechanisms, installations, devices and devices, as well as the production, application (use), transportation, storage of substances, materials and wastes that are sources of physical factors affecting humans, are allowed if there are sanitary and epidemiological conclusions on the compliance of working conditions with sources physical factors of human impact on sanitary rules.

7. The procedure for organizing and conducting production control

7.1. Production control over compliance with sanitary rules and the implementation of sanitary and anti-epidemic (preventive) measures (hereinafter referred to as production control) is carried out by officials of structural divisions and the administration of the organization, who are entrusted with the functions of exercising production control by order of the production unit in accordance with their activities to ensure monitoring compliance with sanitary rules and hygiene standards, the implementation of sanitary and anti-epidemic (preventive) measures. 7.2. The purpose of production control is to ensure the safety and (or) harmlessness for humans and the environment of the harmful effects of objects of production control through the proper implementation of sanitary rules, sanitary and anti-epidemic (preventive) measures, organizing and monitoring their compliance. 7.3. The objects of production control are production, public premises, buildings, structures, sanitary protection zones, equipment, transport, technological equipment, technological processes, workplaces used to perform work, provide services. 7.4. Production control includes: 7.4.1. Availability of officially published sanitary rules, methods and techniques for monitoring environmental factors in accordance with the activities carried out. 7.4.2. Implementation (organization) of laboratory research and testing. 7.4.3. Organization of medical examinations. 7.4.4. Control over the availability of certificates, sanitary and epidemiological conclusions, other documents confirming the quality, safety of raw materials, semi-finished products, finished products and technologies for their production, storage, transportation, sale and disposal in cases stipulated by applicable law. 7.4.5. Substantiation of the safety for humans and the environment of new types of products and the technology of its production, safety criteria and (or) harmlessness of industrial and environmental factors and the development of control methods, including during storage, transportation and disposal of products, as well as the safety of the work process, provision of services. 7.4.6. Keeping records and reporting established by the current legislation on issues related to the implementation of production control. 7.4.7. Timely informing the population, local authorities, bodies and institutions of the State Sanitary and Epidemiological Service of the Russian Federation about emergencies, production shutdowns, violations of technological processes that pose a threat to the sanitary and epidemiological well-being of the population. 7.4.8. Visual control by specially authorized officials (employees) of the organization for the implementation of sanitary and anti-epidemic (preventive) measures, compliance with sanitary rules, development and implementation of measures aimed at eliminating the identified violations. 7.5. Laboratory studies and tests are carried out independently or with the involvement of a laboratory accredited in the prescribed manner. 7.6. The production control program is drawn up by officials of structural divisions. Necessary changes, additions to the program (plan) of production control are made when changing the type of activity, production technology, other significant changes in the activities of a legal entity, an individual entrepreneur. 7.7. The developed program (plan) of production control is agreed upon by the head of the Office of Rospotrebnadzor for the Belgorod Region, which carries out state sanitary and epidemiological supervision of the activities of a legal entity and is approved by the head of the organization. 7.8. Measures for conducting production control are carried out by officials of the structural divisions of the organization, which are entrusted with the functions of implementing production control by order of the production unit. 7.9. At the end of the year, a general report on the implementation of the production control program is submitted to the head of the Office of the Federal Service for Supervision of Consumer Rights Protection and Human Welfare in the Belgorod Region.

8. Duties of officials of the structural divisions of the organization, which are entrusted with the functions of exercising production control

8.1. The official, who is entrusted with the functions of exercising production control, upon revealing violations of sanitary rules at the object of production control, must take measures aimed at eliminating the identified violations and preventing their occurrence, including: 8.1.1. Suspend or terminate its activities or the work of individual workshops, sections, operation of buildings, structures / equipment, transport, performance of certain types of work and provision of services. 8.1.2. Stop using in the production of raw materials, materials that do not meet the established requirements and do not ensure the release of products that are safe (harmless) for humans. 8.2. Officials who are entrusted with the functions of implementing production control are required to: 8.2.1. Comply with the requirements of the Production Control Program. 8.2.2. 9. Responsibility of officials for the implementation
Production control programs

9.1. Overall responsibility for the implementation of the production control program rests with the director of the organization. 9.2. Responsibility for the timeliness of the organization, completeness and reliability of the ongoing production control rests with the heads of structural divisions. 9.3. By order of the organization, officials are appointed to exercise production control over compliance with sanitary rules and the implementation of sanitary and anti-epidemic (preventive) measures. 9.4. For violation of the sanitary legislation for officials who are entrusted with the functions of exercising production control, disciplinary and administrative liability is established in accordance with the legislation of the Russian Federation and the collective agreement of the organization.

10. Activities providing justification

Explanatory note

This training program was developed by the organization's occupational safety service. The program is designed to train persons responsible for the implementation of production control over compliance with sanitary and hygienic (preventive) measures, and production personnel of the structural divisions of the organization. Training is carried out at the introduction of the Production Control Program and periodically before the next test of knowledge.
