The topic of my learning practice is the legal regulation of audit activities in the Russian Federation.

The economy of our country involves the functioning of institutions inherent in the emerging system, which include the legal institution of special entrepreneurial activities of the audit.

For this period, at the moments of a significant change in legal regulation in civil and business law, reforming civil legislation, auditing activities are one of the important economic and legal categories.

In modern conditions, the importance of information is increasing, in the reliability of which a wide range of both external and domestic users is interested, and every year the increasing number of entities of the market is subject to compulsory audit, using the results of which the state monitors their financial activities. Thus, the role of an audit designed to ensure the balance of private and public interests is significantly increasing.

Law No. 307-FZ marked the new stage of legal regulation of the audit, significantly changing the principles of auditing activities, approaches to audit and audit services, the legal status of audit entities. He laid the foundations of a fundamentally new legal mechanism for the interaction of auditors and the state, adequate market needs.

However, the entry into force of Law No. 307 - the FZ does not put the point in scientific research, but, on the contrary, "heats up the interest of scientists. In addition, the practice of the application of Law No. 307 - FZ revealed its certain imperfection, which led to a number of changes and additions to it.

1. The current state of legal regulation of auditing activities in the Russian Federation

Currently, there are several levels of regulatory legal acts regulating audit and auditing activities in the Russian Federation. So V.I. Podolsky and A.A. Savin suggests the allocation of four levels of legal regulation of audit and auditing activities, which includes a law on audit activities; Federal Rules (standards) of auditing, legislative and regulatory regulations; internal rules (standards) of self-regulatory audit organizations; Regulatory documents of ministries and federal services, internal regulations (audit standards). Researchers E.S. Sokolova and Z.P. Arkharov is allocated in the system regulating the audit activities of regulatory acts of five levels. MA Gorodilov also highlights five levels, but according to the structure and the list of acts, they differ significantly from the levels considered by other researchers. With the specified division of regulatory legal acts regulating audit and auditing activities, one can agree, since the presented positions of previously specified scientists - civilians do not reflect the actual modern situation in the audit regulation.

Currently, the legal regulation of auditing activities is carried out in accordance with Law No. 307 - FZ, other federal laws and other regulatory legal acts that regulate relations arising from auditing activities, while characterized by a complex of measures aimed at a gradual transition from state regulation of the audit Activities for self-regulation.

Cancellation of state control in most types of economic activity is provided for by the concept of the long-term socio-economic development of the Russian Federation for the period up to 2020, according to which it is necessary to create conditions for freedom of entrepreneurship and competition, the development of the mechanisms of self-regulation of the entrepreneurial community designated by key principles that the state should follow goals for the transition to innovative socially oriented development.

In accordance with the concept of long-term socio-economic development of the Russian Federation for the period up to 2020, the state target landmark is to provide leading positions in multilateral international institutes ("Group eight", United Nations, International Monetary Fund, World Trade Organization, Organization for Economic Cooperation and Development and Development and Dr.), promotion of priority national interests in bilateral and multilateral trade and economic relations with foreign countries. To achieve these goals, the priority task of the state policy is the rapprochement of national standards with international. In order to implement the tasks and goals of the above concept by the Federal Law of December 1, 2014 No. 403-ФЗ "On Amendments to Certain Legislative Acts of the Russian Federation" a number of changes have been made to the legislation of the Russian Federation on audit activities. Two types of financial information were identified as the subject of the audit:

1) accounting (financial) reporting of an organization provided for by the Federal Law "On Accounting" or published in accordance with it other regulatory legal acts;

2) similar to the composition of the reporting provided for by other federal laws or published in accordance with other regulatory legal acts (for example, the consolidated financial statements provided for by the Federal Law "On Consolidated Financial Reporting"). In addition to this subject, audit defined:

  • part of the accounting (financial) reporting of the organization (one report, article or group of articles, etc.);
  • any other financial information (promising financial information, tax reporting, supervisory financial statements, etc.).

The latter means that the audit service, i.e. The service that only audit organizations and individual auditors can have, are not only an audit of accounting (financial) and similar reporting, but also conduct an audit of any other financial information. The official document on the reliability of such information is exclusively the conclusion of the audit organization (individual auditor).

In connection with the transition from state regulation of auditing activities to self-regulation, one of the main regulatory legal acts that make up the regulation of auditing activities is the Federal Law of December 1, 2007 No. 315-FZ
"On self-regulatory organizations" (hereinafter - Law No. 315-FZ), which identifies the functions of self-regulating organizations (hereinafter referred to as SRO) expressing the essence of self-regulation. Based on the Law No. 315 - FZ, as well as with the peculiarities established by law No. 307-FZ, self-regulating organizations of auditors are created.

In accordance with Law No. 307-FZ, the functions of state regulation of auditing activities are carried out by an authorized federal body. At the same time, the functions of professional regulation of audit activities are entrusted with self-regulatory organizations of auditors (SRO) - non-profit organizations created on membership conditions in order to ensure the conditions for the implementation of audit activities. In addition, it is envisaged to compulsory membership of audit organizations and individual auditors in one of the SRO, in turn, non-compliance with this condition from 01/01/2010 does not allow to engage in auditing activities.

According to paragraph 3 of Art. 7 of the Law No. 307-FZ "On Auditing Activities" Audit organizations and auditors in carrying out audit activities are obliged to comply with the rules of the Code of Professional Ethics of Auditors. At the same time, in case of non-compliance with such rules, the auditor can be attracted by a self-regulatory organization to justice up to the cancellation of the qualification certificate of the auditor. The audit council approved the new Code of Professional Ethics of Auditors on March 22, 2012 (hereinafter - the Code). In the same year, a self-regulating organization of auditors with a non-profit partnership "Audit Chamber of Russia" (hereinafter - apr) was adopted a provision on the professional ethics committee (hereinafter referred to as the Committee), whose task was to consider applications from all interested parties to violate the code by auditors and audit organizations. who are members of the APR.

2. Audit standards as a special form of regulation of audit activities in the Russian Federation

In accordance with Article 7 of the Law No. 307-FZ, auditing activities are carried out by audit organizations, individual auditors in accordance with the standards of auditing.

Audit standards are uniform basic principles that need auditors in the process of professional audit activity. They establish uniform requirements for the implementation of audit activities, design and assess the quality of audit and related services, to the procedure for the preparation of auditors and evaluating their qualifications. Standards are necessary to teach auditors within firms, in addition, they can be used to protect the auditor in the lawsuit.

There are four groups of standards:

- International audit standards developed by the International Committee on Audit Practices, which record the requirements for auditing in different countries. Their requirements are mandatory when conducting an audit of transnational companies;

- national standards developed and used on the territory of individual countries. The federal rules (standards) of audit activity are binding on audit organizations, individual auditors, as well as for audited parties, with the exception of provisions in respect of which they are indicated that they are recommendatory;

- Internal rules (standards) of audit activity, operating in professional auditing associations, rules (standards) of audit activities of audit organizations and individual auditors. One of the functions of professional associations of auditors is to organize an audit based on uniform principles and approaches. For this purpose, professional audit associations can establish internal rules (standards) of auditing on the basis of federal rules (standards) of audit activities for their members. At the same time, the requirements of the internal rules cannot be lower than the requirements of the federal. Audit organizations who voluntarily entering the union are obliged to comply with the requirements of these rules;

- Interfirmen standards. Audit organizations and individual auditors based on national standards, develop their corporate approach to the implementation of various actions of the auditor, enshrined in their own regulations (standards) of auditing activities that cannot contradict the federal rules (standards) of audit activities.

The requirements of the Rules (standards) of the audit activities of the audit organizations and individual auditors cannot be lower than the requirements of the federal rules (standards) of the audit activity and the internal rules (standards) of the audit activity of the professional audit association, whose members they are. The audit conclusion is given according to international standards, then intra-ammable standards should not contradict international.

International audit standards are a generally accepted guarantor of ensuring the reliability of information presented in the financial statements. Initially, the standardization process in developed countries walked apart. The process of standardization of the audit began with the UK, where at the end of the XIX century. A number of laws aimed at protecting property interests of shares holders was adopted.

The standards of audit activities are required primarily for the auditors themselves to determine a clear order of action in carrying out audit activities, thereby providing the necessary level of quality of the audit audits. The basic value of standards is that if the trial will be proven to consistently use the auditor of standards, a significant part of responsibility can be removed from the auditor.

This fact was reflected in the practice of English and American courts, which, as a rule, rejected the claims of customers to the auditors, if the latter managed to prove that in their work they clearly followed generally accepted standards. Under the exit of Russia to international markets, the aspirations of the state to provide an attractive investment climate and transparency of the activities of domestic companies The issue of harmonizing national audit standards with international is very important. However, it should be borne in mind that this process is long and requires consolidation of the forces of the entire audit community.

Thus, the application of international standards of audit activities contributes to the strengthening of financial "transparency" of Russian companies and, as a result, contributes to the involvement of foreign investors.

In accordance with the concept of long-term socio-economic development of Russia for the period up to 2020, the state target landmark is to ensure leading positions in multilateral international institutions ("Group Eight", United Nations, International Monetary Fund, World Trade Organization, Organization for Economic Cooperation and Development and Development and Dr.), promotion of priority national interests in bilateral and multilateral trade and economic relations with foreign countries. In turn, the standards of self-regulatory organizations of auditors were developed in addition to federal standards.

Law No. 403-FZ made a number of changes to the legislation of the Russian Federation on audit activities. The main objectives of these changes are to apply international audit standards in Russia and clarifying the norms of the Federal Law "On Audit Activities" on the results of the analysis of law enforcement practice, as well as in connection with the latest changes in Russian legislation. As such standards in Russia, according to Law No. 403-FZ, international audit standards adopted by the International Federation of Accountants will be applied (previously - federal auditing standards approved by the Decree of the Government of the Russian Federation or the Order of the Ministry of Finance of Russia). It is worth noting that international audit standards may apply in the territory of the Russian Federation only after recognizing them in the manner established by the Government of the Russian Federation.

In accordance with the new provisions, self-regulatory organizations of auditors are exempt from the obligation to develop projects of federal audit standards (after the end of the transition period). This, however, does not deprive self-regulatory organizations of auditors the possibility of active and active participation in the development and discussion of projects of international audit standards (within the framework of the procedure adopted in the International Federation of Accountants), in the discussion and examination of the applicability of international audit standards in Russia, in preparation and discussion Projects of regulatory legal acts on the recognition of international audit standards for use in the Russian Federation.

Thus, as they are recognized:

  • international auditing standards will be binding on audit organizations, auditors, self-regulating organizations of auditors and their employees, as well as audited parties (persons who have entered into an agreement for the provision of audit services);
  • the Federal Standards of Auditing, approved by the Ministry of Finance of Russia, and the Rules (Standards) of Auditing, approved by the Government of the Russian Federation will be familiar to the strength.

According to a new regulatory legal act, international audit standards are subject to use, starting in the year following the year in which they will be recognized in Russia. The transition to their use in Russia must be implemented in the following dates:

  • no later than October 1, 2015, the Government of the Russian Federation should establish the procedure for recognizing international audit standards;
  • no later than two years since the entry into force of this order, international audit standards should be recognized in Russia;
  • recognized international audit standards should be applied in the provision of audit services, starting in the year following the year of their recognition.

In the transitional period, auditing activities should be implemented continue in accordance with the Federal Regulations (standards) of auditing, approved by the Government of the Russian Federation, and federal auditing standards approved by the Ministry of Finance of Russia. In addition, audit organizations and auditors should also be guided by federal audit standards that can be accepted during this period.

If necessary, the approval of new federal auditing standards in the transition period will be the following procedure: self-regulatory auditors are developing standards projects in the manner approved by the audit board; The audit council considers such projects and recommends their Ministry of Finance of Russia to approval; The Ministry of Finance of Russia approves standards.

At this transition, according to Article 2 of Law No. 307-FZ, auditing activities are carried out in accordance with the standards of auditing activities. The law No. 307-FZ is obligatory are the federal rules (standards) of auditing, approved until the day of the entry into force of Law No. 307-FZ, i.e. Rules (standards) of auditing activities approved by the Decree of the Government of the Russian Federation of September 23, 2002 No. 696.

In addition, in the implementation of audit activities, the rules (standards) of audit activities approved by the Commission under the President of the Russian Federation on auditing activities are applied (taking into account the decision of the Council for audit activities under the Ministry of Finance of Russia of September 25, 2008).

Federal auditing standards are regulatory legal acts of imperative regulation. Currently, federal auditing standards are mainly approved by the Decree of the Government of the Russian Federation of September 23, 2002 No. 696.

In total, 34 federal regulations (standard) of audit activity of which at the moment are currently raised in connection with the entry into force of the relevant standards approved by the Ministry of Finance, the Government of the Russian Federation is approved by the Government of the Russian Federation to the present.
