How to issue a certificate at the place of demand from work - sample and rules
A certificate from the place of work at the place of demand may be needed in a variety of life situations:
- when considering civil cases in courts;
- for registration of benefits and pensions;
- when obtaining a visa at the migration services;
- to resolve the issue by the bank about the possibility of issuing a loan;
- to law enforcement agencies;
- to receive benefits from utility management companies
They are usually issued in any form. But some institutions insist on a certain form of certificate from the place of work at the place of demand. In such cases, they provide a sample of it themselves.
How to issue a certificate
The requirements for the certificate form are the same, regardless of their content. They are not established by law, but an indication of them is contained in various departmental instructions and rules. In practice, the following criteria have developed, which they correspond to:
- they are usually issued on company letterhead. If there is no such in the upper part, they must contain indications of the company details, in the upper left part - the date and outgoing number;
- in the middle of the text, the name of the document is written, followed by the text. When specifying information about an employee, abbreviations should not be allowed: when writing his name, job titles, departments;
- the document is signed by the head or a person replacing him;
- corrections, erasures are not allowed in the text.
- the name of the body for which the information has been prepared is indicated, or it is simply indicated that this is a certificate at the place of demand;
A certificate from the employer of an individual entrepreneur is drawn up according to the same rules. If other documents are attached to it, then the data about them must be indicated in the appendix. The information provided must be accurate and up-to-date.
How to get job information
In many organizations, there are no problems with obtaining certificates. Enough oral appeal of the employee to the personnel service, which deals with their registration. If you need data on wages, it is better to contact the accounting department. But, if the enterprise is large and has a large staff, then the employee will have to write an application requesting its extradition. The law is allowed not to indicate for what purpose it is required. The employee can, if he wishes, indicate why he needs the certificate. He has the right to attach a sample of it to the application. After that, at the end of the established period, he can pick up the finished document.
Usually, it takes no more than three working days to complete it. The administration has no right to refuse an employee to issue information about his work. The employee's right to receive such information is enshrined in law. If the employee quit, then the right to receive a certificate from the last place of work (and not only) remains with him. But the information provided to him can only relate to him personally: the length of service, the position held by him and the amount of salary.
Each body itself determines the period during which the document submitted to it is considered relevant and accepted by it. There are no precise indications in the law on the duration of its validity.
Features of certificates depending on its content
If the document is required by the court, then the information requested by it is included in it. For example, for a criminal case, only data on the work of the defendant is important, which may testify in his favor when imposing a sentence. In civil cases, salary data are usually also requested to determine the amount of alimony or compensation for damage.
The migration services are interested in the employee's length of service and his income. This information is used to determine the credibility of the visa applicant. Social protection authorities request certificates to make sure that the citizen is not on parental leave and is not receiving benefits. Income for a certain period of time is important for obtaining a pension.
The main thing to remember is that there should not be any obstacles in the issuance of the above certificates. The employee's right to receive them is enshrined in article 62 of the Labor Code of the Russian Federation.
